No fault state. (FL)

So heres a little spin on the current talk in L&P.

Floridas no fault insurance policy.

A few days ago, while on my way to work, I pull into a Circle K to get some gas.
Some guy in a tie on his cell phone pulls in, driving a huge black SUV (Lincoln).

The guy side swiped my car, leaves a 12 inch scape on the passanger side of my car, and also clips the mirror, leaving it cracked, but intact.

I yell at him and he rolls down his window, still on his cell phone, with a little smirk on his face, and says "oops sorry".

And just rolls up his window, turns around the fuel pumps to the other side, and dismounts his vehicle and looked like he was going to get some gas.

I walk up to him, and tell him that he cliped my car pretty good, and he walks over...still on his cell phone, still talking to the person....he walks to the side he hit my car on, and he said "oh thats it? go to your car insurance, thats a minor scratch!".... by this time I was already behind his car writting down his tag, and I also, got the VIN off of the dash of his car, took pics of my car, his truck, and one of him.,,,you guessed it..still on his phone.

I told him I was calling the police, and he said ok, called them, he even offered to call them for me. So I called the police...ETA on a non emergency accident was 1 hour... I told them I couldnt wait and I had to file a delayed accident report after work.

Well, My insurance deductible ($500) is about the cost of total repairs, according to my insurances body shop, so it really isnt worth going through the insurance, since MY rates would go up, due to someone else!!!!

The only thing I can think of is to take this guy to small claims court!
Anyone have any other input on no fault states?
 
If you were in the car how does your neck feel?

Whip lash is SOO common when a jerk hits you like that. Aside from that I think your on your own.
 
small claims court yes,his insurance will have to pay any damages,not your insurance company......thats how it is in mi anyway.
 
Did you get his insurance/DL info? If so you can simply go through his insurance for the repairs and not report it at all to your insurance company. That's what I did in my last incident and it worked out fine. If you asked him for his insurance/DL info and he failed to provide it then I think you need to incorporate that into your accident report and press the police to take action on it as that is a crime in florida. Actually, if that happened you should have called back to the police and you would have gotten a higher priority on their response list...for future reference.

If you don't have his insurance info, since your repairs are less than your deductible it isn't worth going through your insurance company so small claims court is your only option. Get some good pictures of your damage and pictures of the Circle K with your car parked where it was for court. Eyewitnesses if you have them would be great.

Also, if you have to take it to small claims court you can also possibly get "diminished value" which is the difference you'll get on trade-in on your car because it's been in an accident.
 
I dont know how it there in Florida but if a guy fails to pay up of provide insurance for an accident once a police report is filed the DPS will yank his drivers liscense. I had a wreck where a guy hit me form behind....he had cancelled his insurance. My insurance company filed the paperwork to have his drivers liscense yanked. If he ever pays up I will get my deductible money back.....I think the sun will probably implode about that time.

Yes you can file a claim with his insurance company...

I would consider taking him to small claims court.
 
In MI its no fault, and the police will not issue a ticket for anything that happened on priveta proprety at least. I was in my friends driveway and a guy pulled in to change directions, hit my car, police couldnt issue aticket, i ate the cost.
