NJ's "Graves Act"...

I don't know what you're asking exactly.

Yes, Airsoft or BB guns are either spring or "air" but the subject of the underlined text is HANDGUN.

It says that under the conditions of the law, possession of a HANDGUN is a violation unless it's a spring or air gun.

I'm wondering what the difference is whether the airsoft gun the man was arrested for shooting was a rifle or a handgun. Even though the news article doesn't say, I don't see what difference it would make.

However, I'm primarily a handgun guy, so I'll admit I'm guilty of assuming the guy was shooting a bb pistol and not a rifle. I still don't understand why in NJ one is okay but the other is not.

Wait I'm confused. From the underlined part it seems that air or spring guns (or atleast air and spring HANDguns) are actually exempt from the law. What's the problem here exactly?

Wouldn't be anything new. Here in NYC air powered guns like airsoft guns are actually more tightly controlled than real firearms (there's that common sense gun control for you) You can atleast get a permit to own a real gun. BB guns are just outright banned with no real legal provisions for owning one.

Though there is a big airsofting community in NYC and the general understanding is the NYPD doesn't care about airsofters and their guns. As long as you don't act stupid or otherwise illegal with it and they don't have any other reason to arrest you they won't bother you over it if they happen to find it in your trunk for example during a traffic stop.

So while illegal. The unwritten rule is be discreet and responsible and you'll be fine.

Any law that imposes penalties for possession of a gun; or imposes even grater penalties just for possession of a gun is a BAD LAW.

Oh, I'm not worried about me, I live in Vermont... :D

I'm just dumbfounded as to the idiocy that is New Jersey legislation.
