Effective May 2, 2006 a FBI NICS Background check is required in NYS when purchasing either purchasing a handgun/long arm even for valid permit holders. The only exception is if permit was issued in the last five years and issuing authority conducted NICS check prior to issuance of said permit. ATF form 4473 is used by FFL to initiate check prior to sale of firearm, however one of the Federal Disqualifiers in NICS Index states that a person whose separation from the U.S. Armed Forces resulted from "Dishonorable Discharge" is prohibited from obtaining a firearm. It goes on to state that this catagory only includes separations resulting from dishonorable discharge or dismissals (e.g., a bad conduct discharge is not included). I received a "Other Than Honorable" discharge which is administrative not punitive (example : Bad Conduct, Dishonorable) meaning a court-martial was not convened and sentence was not issued as punishment. On form 4473 "Dishonorable" is in bold. My understanding is that unless it was clearly a dishonoralbe discharge this should not prevent me from purchasing any type of firearm since my discharge was not listed as "Dishonorable".
