NICS 2 weeks?!?

I've been delayed on my nics check for two weeks now:mad: I looked on theyre website and read all the disqualifying factors and I dont have 1:confused: What is the deal? has this ever happend to any of you?
 
I believe they have 3 working days (72 hours) to make a decision. After that, you automatically clear unless they deny. They can call a delay but it expires at the end of 3 "working" days.
 
nemesis is right. The shop where you bought the firearm should have called you by now (assuming you left a contact number) or you should call the shop and ask them what's up. They can release it to you if it's been three working days (no weekends/holidays) without a reply from NICS. NICS even tells the shop what date they can release it.
 
I went up there (Academy) on Thursday, at that point it had been exactly 2 weeks. And they basicly said they can't sell it untill they got a approval from nics. I even told him about the 3 day rule, Hell I even printed it up from the FBI website. But no luck, I know they could go to bat for me and have a lot more pull than I do, I even called the FBI to ask them what was up and they said they couldnt release any information to me over the phone. Normally I would just take my buisness elsewhere but nobody else has the gun I want for the price I can get it for at Academy. It just really frustrates me that I am in this catch 22. So I guess they got me by the short & curlys. All I can do is wait, I can really see why people go through local gunshops now though :rolleyes: Thanks for all the input and if anybody has any suggestions on lighting a fire under the nics' (I) let me know.

the way i understand it, its the retailers decision after 3 days whether or not to release it to you.

the retailer has the right to refuse the sale.
 
You're talking about an Academy? Not a retail shop?

There is a form you can request to find out why you've been denied. The retailer (not sure about an LE source) must supply you with the NICS transaction number so you can give this to the FBI. I don't understand what's going on in your situation.
 
yeah academy is a sporting goods store, I guess Texas has turned pinko. My main problem is that I havent even been denyed so i cant get a ref# Im just still delayed. So much for the constitution huh?
 
TexiCali, I believe NICS gives the FFL the reference number during the initial call.

Does Academy Sports have a good deal on something? If not, tell them to stuff it, find the gun online, and find a nice small FFL with a low transfer fee. Or, if it's a common gun, you could try to find someone local who's selling one.

Don't let them pass the buck to NICS. Ask whose decision it is not to release the gun, and grill that person. Maybe WildAlaska or some other FFL here can give you some stats on how often NICS simply doesn't call back; if it's significant, and I suspect it is, maybe that would convince Academy to finish the transfer. The only time I know I was delayed, NICS called the FFL back after two and a half days.

It seems to me like Academy is telling you they don't want your money.
 
if you live near Houston, Austin or some other big city I believe you could beat or meet Academy's price unless its a special sale. At our Academy there is a firearms dealer next door. I dont buy any firearms from Academy :D

Since Academy is a chain they probably have a corporate website. It would be worth a shot to e-mail customer relations. I have done this several times with chains and have gotten more than satisfactory answers and solutions.
 
Ok I called academy today and a girl that worked there was actually pretty helpfull she called nics and they just said I was delayed and they didn't give her a reason why. However she told me that she has seen it take up to 30 days from them to hear from them. I looked at a local gunshop that was very friendly and they had the winchester defender that I want used, but it had a pistol grip and was only $40 bucks less than the new defender at academy, I tried to haggle with the guy but to no avail. I guess im just gonna wait for academy to get the call from nics, they have it for a killer price and I dont want to settle for somthing I dont want or have to pay more for my impatience, but if anyone has had to wait over 3 weeks please post and tell me how it worked out.

I agree with the other folks - since Federal Law absolves them of responsibility if NICS doesn't return a negative result in 72 hours, I'd pay extra to avoid buying from them.

You ought to be able to find a new one on-line and have it shipped to a local dealer.
 
Well today makes it 4 weeks, I know this is my own problem for sticking with Academy but it would also be nice if NICS would get off theyre butts and help me out :mad:

Well today I went by academy to have them hold my shotgun for another 30 days while I appealed my delay through the NICS. The guy behind the counter went to get my gun to put another hold on it and told me "Oh we must have sold your gun because of the delay":mad: So needless to say I was upset at best, I couldnt even chew him out I was so mad. So needless to say I called around to different gun shops to find a defender 1300 and nobody had one in my area of DFW TX. So I am going to have to drive aboutr a hour and a half to get my gun somewhere else. They will sell after 9 days of being delayed, it just makes me wonder if they have cleared me on the gun all along and Academy was giving me the run around or what? oh well, lesson learnerd and thank you all for the imput it looks like you were all right all along.
