nice simple question

Someone spoke of looking for a pre-ban HiPower Practical. I suspect he just meant one with high cap mags with it.

On the other hand, I have a pre-ban Practical. Stocked up on mags before hicaps dried up.

So here's the nice simple question: Say I buy a spare Practical, post ban manufacture with 10 round mags? If I insert a preban mag into a postban gun does the BATF consider I've committed a felony?
 
Hello, Rusty S! As the previous poster noted, it is not unlawful for you to own, use, sell, possess, etc any pre-ban high cap magazine. You can use it in a new firearm.
If you like the HP, I'd get another especially since they will only get harder to come by. If I really like something, I try to have "a pair and a spare." Best, sir.
 
Hmmm... Stephen, does that mean like a pair of blued 58's, a nickeled 58, a blued 57 for load selection ( adjustable sights ) and a 28 blued hiway patrolman for subcaliber practice with 38's - all with 4" barrels?

I suspect we are talking the same language.

I asked the same question awhile back and got the same answers. The folks at a local gunshop I deal with say the preban mags are not to be used in a postban weapon but I don't know how an LEO could tell if my beretta was pre/post ban unless he done a search on the serial# because there is no date on it anywhere. Also, I have a couple of catologs that sell hi-cap mags and there are disclaimers on their ads stateing the mags are not to be used with post-ban weapons. I would like to think that is B/S but I have seen it stated both ways . If someone knows where this could be researched and let us know without a doubt, I would appreciate it and I could relay the info to the shop I deal with so they wouldn't keep passing on false info--Thanks
 
I think that you can use pre-ban mags in post ban pistols. Some guns (ie, the Walther P99) are all post ban, but there are hi-cap clips for them. However, I'm not so sure about the so-called "assault weapons". I know that some of the post ban AK-47's listed in the shotgun news have disclaimers saying you can't use hi-cap clips.
 
Hey, but which ban are we talking about? At one time, Hi-Powers (P35s) came with detachable stocks. Isn't putting a stock on a pistol illegal now, except for Lugers, Mauser c96s and the P35's?
 
Pretty much what I thought. It all depends not on the actual law but what the folks in power say it means.

The present administration is waging a hate campaign against us, and if you come to their attention I believe they'll not stop til they find or invent something to charge you with.

I'm going to check some serial #'s and pick up a preban.
 
As far as federal law goes, there are no "pre-ban" or "post-ban" pistols. Those terms apply only to semi-automatic so-called "assault rifles".

The high capacity (over 10 round) magazine "ban" applies ONLY TO MANUFACTURING, not to purchase, ownership, sale, transfer, or use of magazines already in existence at the time the law took effect.

The only prohibited magazines are those high capacity magazines made after the law took effect for military/law enforcement only and so marked. These are prohibited for civilian ownership. Otherwise, you can use any magazine you own in any pistol it fits.

Note again that this is Federal law. State or local laws may impose other restrictions.
