NFA manufacture

does anyone know the application forms needed to manufacture nfa items? I've found the ones for importing but not manufacturing.

You can get the forms here; http://www.atf.gov/forms/firearms/ The below forms are for manufacturing as a business.

The FFL; http://www.atf.gov/forms/download/atf-f-5310-12-notice.html $200/3 years.

The Special Occupational Taxpayer; http://www.atf.gov/forms/download/atf-f-5630-7.pdf $500-1000 / year

The ITAR; http://www.pmddtc.state.gov/regulations_laws/itar_consolidated.html http://www.siaed.org/en/art/207/ $2250/year minimum as far as I know. I know nothing about how one goes about paying this fee.

This stuff is why I settle for paying $200 on an ATF form 1 for each silencer I make. If you are making a few as a hobby, then using the ATF from 1 and paying the $200 tax on each is a better way to go in my opinion.

I believe all newly manufactured NFA itmes are registered on a BATFE Form 1.

Most newly manufactured NFA items are registered on the ATF from 2 which is used by the FFL/SOT that manufactures them. The form 1 is normally only used by those who do not have a license, although an FFL is allowed to use them.

I had to use a Form 1 to register a USAS-12. The reason I even know anything about Form 1's was because filling it out for an existing shotgun didn't make much sense to me, so I called BATFE and asked how to properly fill out the form. They explained that it's really structured for the manufacturing of NFA items, and that the USAS-12 ruling was something a little different so the Form 1 doesn't quite fit, but it's what is used.

When I registered my USAS-12, I did not need to obtain a CLEO sign-off because I already owned the gun. Now, if you make your own silencer and register it on a Form 1, do you need a CLEO sign-off if you are not a licensed Class III manufacturer.?
 
The sheriff's sig is needed for anyone who fills out the form 1 for making a title 2 weapon. It is not required if you use a trust or Corp. to own it for you.

I think it is less confusing if you think of companies like Gemtech and AAC as licensed manufacturers and people like me who make them without a license using the form 1 as makers.

I read that the USAS-12 was a title 2 gun, but did not know that it could be registered on a form1 without the sheriff's signature.

He is talking about the original registration back when ATF re-classified the shotgun as a DD. Since he already owned the firearm, no CLEO signature was required.
 
Excise tax to manufacture

There is also a 10-11% excise tax that is paid for all complete manufactured firearms by a manufacturer. More taxes to pay...
