New York State Open Carry Laws

Well, it appears that the literal reading of the law says you cant. (not a lawyer, nor offering any binding law advice, just my take). If you already own a firearm, then you have already broken the law by just taking it home, or going to the range with it.
 
If you are hunting and a a cop sees you you will probably be asked to show your permit. Assuming you're not doing something stupid that will probably be all. While target shooting on public land I have been asked to show my permit. While hunting I do carry concealed if for no other reason than it protects the gun from the weather. Walking on the road may get a different reaction both by cops and the public. I would suggest that if you have the concealed carry permit , carry it concealed it may save you inconvenience. BTW in NYS we have the concept of multiple use for public land ,which means while you are hunting you might meet hikers etc. Here in the Catskill Mtns those hikers may be folks from NYC who are clueless and terrified of guns.They may react very differently to a handgun than to a rifle or shotgun.
 
There are only 2 pistol permits issued in NYS, one is a premis and the other is a carry. Look at the number on the permit it will start and end with a C or a P.
(Of course NYC and Nassau county have thier own laws) In the last 30 years or so some counties are now able to issue restricted permits. These restrictions are for the county issued. The restrictions are debatable, in Erie county durring the 80's Judge Penny Wolfgang lifted all restrictions and people were going up for clear permits. Today those same people are having the restrictions put back on when they show up at the pistol permit office. It's a game they play. Move over one county and try to get the restrictions lifted and a clear license, they won't waste thier time and tell you they mean nothing. Go figure, they tell you your registered in the state as a carry permit. I have 30 or so friends who are NYS Troopers, none will hold people to restrictions for having a firearm as long as they have the NYS pistol permit.
Local police in your county may have a different view if the restrictions were placed there, it gives them power. Open carry is allowed while hunting, this thought process is stupid and people aren't using common sense. I'll research it and post the facts/law.

I,ve had a carry permit in N.Y.S. for years and throughout these years I have seen guys carry openly in,

restaurants, diners,pumping gas,of course hunting, fishing, and even in
Walmarts. It,s not often, but it happens. During deer season it,s nothing
unusual at all to see this in public places. The carry permit is a complete permit to cover in home or at range shooting to carry concealled.

I do not believe police will give you a hard time (unless) you carry in open
to act menaceing in any way.

People are used to seeing long guns yet the long gun is more deadly than any handgun in general.
Everyday I drive a big weapon to and from work, my car. It,s how we look at the reasoning of things. Keep the imput comeing.
Weirdest thing I seen while carrying openly after comeing out from deer hunting opening day was a staredown.
I was wearing my wool red and black checkerd pants.On my belt was a 12 round carry string of 7mm magnum ammo and on left hip in my holster was my 41 mag. Ruger.. The weather was quite warmer later in the day and i,d
stopped for fresh anything at a fruit/vegtable market.
This guy was checking out behind me in line. I smiled politely to the clerk
and paid for my goodies. This guy started stareing at me and never stopped even while putting my items in back of my van. We stared at each other I
was waiting for a question but all he would do was stare. It was my feeling he,d been watching to much C.B.S. news.
 
I work in a conveinance store and we get people hunting every year that carry openly, I do not feel threatened by that. However; one time there was a girl in another Stewart's shop who saw a man reaching into his coat and he had a piece on him and she pushed her button immediately. It all depends on the context of the situation.

There are no open carries allowed in NYS unless you are a LEO. The available selections on the permit app are Premises, Concealed Carry, and one other which I forget but it wasn't open carry. That is why we have to go to a NRA sanctioned pistol safety course which discusses concealed carry.

We have restrictions on our permits though to hunting/target or hiking, fishing etc. Also if someone is lucky enough to get an unrestricted license they can carry wherever legal CONCEALED. Except the usual, schools, post offices etc. etc..
