New Hampshire Handgun Laws

Hi, I'm 17 and I’m looking for some information on NH’s gun laws. I’m going to be getting a Sig P226, my parents are buying it for me I’m paying. I’m wondering if it is legal for me to carry this unconcealed when I’m 17, 18 or if I have to wait until I’m 21? Also what age would I have to be to get a concealed weapon permit, and what is the process of getting one in NH. Just Curious I have no reason for a CCW so I wouldn’t be getting one anyway.

Thanks :)

"A person under age 18 may not possess a handgun or handgun ammunition, and it is illegal for a person to provide a handgun or handgun ammunition to a person under age 18, except for target shooting, hunting, or certain other exempted purposes. (Youth Handgun Safety Act, 1994)"

See 18 USC 922(x)(3) for exemptions, having to do with transportation directly to and from exempted activities, or in farming/ranching activity.

Also, you should very careful of how you structure the purchase of the firearm with your parents, so that it won't be considered a "strawman purchase" by the ATF.

Before you proceed much further, I think it would be sensible for you to consult a lawyer on these issues, as the penalties for these so-called "crimes" is significant. Penny Dean, of Concord, is well-versed on the intricacies of gun law, and would be a good person to contact.

She'd also be able to answer the question of at what age you're permitted under the law to carry a handgun, openly or concealed, in New Hampshire.

I asked a New Hampshire CCW instructor that (and he answered every question correctly according to the laws that I'm familiar with, so I'd place some credence in his answer) and he answered that he wasn't aware of any age limit per se. As a practical matter he (and I) suspect that pre-18s might require a bit more justification than adults do depending upon the issuing authority, and that is backed up by packing.org's "18?" answer to that question.

(I'm more familiar with this question than most since my 18-year-old is considering getting a CCW here in NH.)

And the FEDERAL issue?

"...he answered that he wasn't aware of any age limit per se."

Are you telling us that your instructor was not aware of Federal law on the issue, or that you don't think Federal law applies in NH?

Again, in case you missed it in a previous post from mvpel:

"A person under age 18 may not possess a handgun or handgun ammunition, and it is illegal for a person to provide a handgun or handgun ammunition to a person under age 18, except for target shooting, hunting, or certain other exempted purposes. (Youth Handgun Safety Act, 1994)"

And New Hampshire doesn't require training for issuance of a concealed-carry license - if your local police or other issuing authority is demanding it, they've found yet another innovative way to break the carry license law and you should contact GO-NH and let them know.

Thanks for your help...

Not really the answer I wanted though. :( Also are there any training programs for "youths" I was interested in the Sig orientation to handguns in Epping but you must be 21.

I'm getting a Sig P-226 as soon as my tax return comes in. :D

It’s amazing, I’m going to be an adult (18) “woo hoo” I still can’t do anything in this damn country!

Yeah, the second-class-citizen status of adults age 18-21 really irritates me too, and I'm 34.

They perfectly happy when you vote Democrat, but they won't give you your full adult freedoms.

If you can make it to the next GONH meeting, it'd be great to meet you - third Tuesday of the month at the Holiday Inn in Concord, at 7:00pm.

mvpel gives good advice.

Penny Dean is a good lawyer, a nice lady and is currently defending Blake Douglass who just wants his picture of himself in his trap shooting outfit, shotgun broken open over his shoulder, for his senior picture.

I have spoken with and traded several emails with Ms. Dean over the past few weeks. Her email is Pennydean@verizon.net and her phone number is 603-230-9999 (leave a message and SHE WILL get back to you). Maybe she can be of some assistance.
