Since the new "shoot when threatened law" was signed I have been trying to keep up on my states laws . Where can i find all of the florida laws. The laws i found online arent up to date (i think). Not to mention kinda sketchy on the terms. For instance carring a cw in a bar, as far as i know you can if you dont sit at the bar. I want to find something in black and white, hear say wont hold up in court.
 
Threads like this make me crazy. I'm from Florida and have a CCW. I also know what the new law says and it's not shoot when threatened. The law for use of daedly force has not changed, that's right. The requirement are still the same, EXCEPT you don't have to retreat which is how it should be. Why give the criminal the edge?
 
WOW sorry to strike a nerve. I forgot that you have to type exactly what you are tring to say or it hits the fan. I realize that you cant just get P O'd at someone and shoot them because they threatened you verbaly. I understand the way the law is writen. What i was wondering is if you can carry in to a "bar" . The rule of thumb the teacher of my cw class used
(this applies to florida B/C you cant smoke inside a resturant) was if you can smoke inside you cant carry. Is there a CCW for dummies out there? The class I took was quick and focused more on saftey than the do's and don'ts of where you can and where you can not carry.

Never thought of it that way but, in Florida, it's a good theory

I know you were just giving an example of simplifying the topic but that is just about the scarriest statement I have ever read. So frightening that it is kind of funny. In a very strange and spooky way.... :eek:

Florida law says that you can not carry in :

any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose;

This means that i can carry in side a resturant with a bar i just cant sit at the bar. Does this work for clubs also? If im not at the bar right?

No in a club all areas are primarily devoted to the consumption of alcohol

Wrong you can not even enter the bar area, even if you have to walk through it to go to the restroom
 
Well then , How do we get that changed?

Option #1: Hire thugs to acostle your state legislators when they're at bars, so they'll recognize the need for people to be able to protect themselves in those situations.

Option #2: Voice your concerns to your local representives and get active with organizations who have a similiar agenda.

Get enough people, that think drunks with guns is a defendable idea, to sign a petition to change the law
 
Well, drunk with guns doesn't actually have to be a defendable idea. It could be pushed to change the law so that being drunk with guns was illegal, not simply being in an establishment that serves alcohol. The law makes about as much sense as saying it's illegal to drive to a place that serves alcohol... well, actually a law like might save more lives than the prohibition on firearms. After all, there's no silly restriction on carrying firearms into a bar here in NH and I've yet to see any drunken gun fights... not a single one.
 
I highly recommend this book if you are CCW'ing in Florida. This book dispels a lot of the myths you hear from people about where, when and how you can buy, carry or transport firearms in Florida, or defend yourself in Florida. And it's a lot easier to understand than interpreting the law yourself from the statutes.

You know that, I know that, but try to convince the masses number one that anybody goes to a bar not intending to get drunk and then that having a gun in a place where you go to get drunk is a good idea.


We can't even have a decent strip club in most towns

I am not a lawyer and I don't play one on TV. There is no such thing in black and white in court. If you are the defendant, your attorney will say you are innocent and paint you out to be a saint. The prosecutor will make you out to be the devil himself and say you are guilty as sin. You have 12 jurors in most criminal trials. Do you think 12 seperate ideas constitutes black and white?

The actual statues are important to know but most court cases are rarely ever black and white (OJ Simpson and Michael Jackson for example and I'm not talking about skin color. If I was, Michael Jackson's case would be considered white and white!!! :p :D :eek: )

It is always safer to err on the legal side of the law.
