So today the Florida House passed a bill that gives people freedom from prosecution if they kill someone in self defense. Its called the Shoot to Kill law or Deadly Force bill if that rings any bells. Do you think it will turn FL into the Wild West or reduce crime?

A lot of the Media said that when CCW was passed that the states with it would be "Hip Deep" in blood. Nothing of the sort ever turned out! In the state with CCW the crime rates have gone down. :)

CCW holders are just about the most law abiding people on Earth!!! :)

Is there anywhere on the internet that anyone knows right off hand that explains the details of this new bill??? I need specifics!!!
 
OK. Did they solve the peek a boo and off to jail you go? IOW, if your CCW flashes, you can be charged with criminal offenses. What charge is up to the prosecutor.
 
That's interesting, because I studied the state of the law here when I got my CWP and found that use of deadly force in self defense was acceptable in this state. So what did the law really change? Before the law, you shoot someone, you'd better be prepared to explain why you were in fear for your life and had no opportunity to retreat (unless in your home). Did they change the duty to retreat part?
 
I dunno .... I think this matter could be construed to affect interstate commerce in some way other. Perhaps the Federal government ought to decide under what criteria Florida residents can exercize their right to defend themselves ;)
 
More good news, look later in the bill to the mention of autos, not just homes. No duty to retreat is very important, especially when the number and location of hostiles is unknown or when retreating makes one vulnerable.
 
It's good on a moral level as well as a tactical level. When the good guys are given the freedom to stand up to the bad guys, life improves for everyone.

It's that simple. When the bad guys push forward, you need to push back.

For those not interested in reading the bill referenced above, the new law creates several important changes;

1. It writes the Castle Doctrine into the text of the law. This prevents some courts from eroding it.
2. The law states that when someone commits an unlawful and forceful entry into your home, business, or vehicle (this even extends to a tent) it is presumed that one is in fear of his life or great bodily harm and then is justified in the use of deadly force.
3. In the event of such shooting unless the police have reason to believe that one of several exclusion exist, you may not be arrested. The exclusions include someone who has a right to be in the home, police after having identified themselves in the performance of their diuties, or the house is a site of criminal conduct.
4. If you are arrested contrary to the law or if a civil suit is filed incident to a righteous shooting you are allowed to revover any legal cost incurred and any lost wages.
5. When in a public place that you have a right to be, the duty to retreat has been removed. Nothing else has been changed regarding the use of deadly force in public.
 
CNN had their panties in a wad about it this morning.

They quoted someone from one of the anti-gun groups who used the obligatory "Old West" line of bull****.

You'd think that, after what, 25 states enacting CCW laws after Florida, and a number having them before Florida, all without the rivers of blood in the streets that have been predicted, that the Old West comparisons would go away.
 
Gotta love Florida!

I about cried with happiness when I read this!!! Now when someone breaks into my home, I have no fear of being sued.

this law works for me.Under the old law you had to be on the ground and someone kicking you to death before you could do anything.Well I quess we shall see how this works.Won't take long for someone to use this . :) The worse part you could be in the right and they could sue and win in civil court.
 
If there was work out that way I would love to move back. Northern Florida that is, the Central and Southern parts are too over run with yankees :p
