Need information

Im in need of some serrious help im a 18 yearold civil war reenactor and need some info on hand gun laws in texas I have a 1860 colt revolver and a 1847 colt and 1853 enfield rifle and was wondering if I could travel with the firearms unloaded of couse, and if I can legaly own a 1873 colt SAA
any help that can be found is greatly needed
 
Welcome to TFL! I'm not an expert on the subject, but last time I looked into Texas state law, it was clear that an 18 year old can own and possess a handgun, you just can't buy it, or ammo for it. You can also keep an unloaded or loaded handgun concealed in your car without a CHL. There's no restriction on longuns in a vehicle. You can even get a CHL at 18 if you want. That would probably help if you're pulled over and the officer has a doubt whether or not you can have a handgun with you.

When it comes to antique, C&R, or replica firearms, I have no idea, but I don't think they would be any more restrictive than modern firearms.

The best advise would be to dig deep and look at all the firearm and weapon related laws in Texas. Don't trust anyone elses word on the subject, including mine. Trusting a LEO's word on something that he said was "legal" almost sent me to prison once. Thank God the LEO that pulled me over was understanding.

I will say that in my experience LEO's are not always the most knowlegable in the very laws that they enforce. It's not their fault, they're not lawyers. If you run into a LEO who has a problem with your handgun just be polite and explain yourself, and get a lawyer if needed.

Hopefully someone with much more expertise on this subject can chime in. I just thought I'd throw in my $.02 until then.

OOPS. I might have been wrong about the CHL. I thought it was in there, but I might have been thinking of another state... I'll try to keep looking for you.

Nevermind here it is, from page 11 on the 2nd link above.

a person who is at least 18
years of age but not yet 21 years of age is eligible for a license to carry
a concealed handgun if the person:
(1) is a member or veteran of the United States armed forces,
including a member or veteran of the reserves or national guard;
(2) was discharged under honorable conditions, if discharged
from the United States armed forces, reserves, or national guard; and
(3) meets the other eligibility requirements of Subsection (a)
except for the minimum age required by federal law to purchase a
handgun.
(h) The issuance of a license to carry a concealed handgun to a
person eligible under Subsection (g) does not affect the person's
ability to purchase a handgun or ammunition under federal law.

So if the I'm reading this right... If the only thing that's keeping you from legally purchasing a handgun is your age, you can still get a CHL. So I'm sure you can possess a handgun at 18. I'll keep looking for that part.

Here's the part about the car:

PC W6.02. UNLAWFUL CARRYING WEAPONS. (a) A person
commits an offense if the person intentionally, knowingly, or recklessly
carries on or about his or her person a handgun, illegal knife, or club if
the person is not:
(1) on the person's own premises or premises under the person's
control; or
(2) inside of or directly en route to a motor vehicle that is owned
by the person or under the person's control.
(a-I) A person commits an offense if the person intentionally, knowingly,
or recklessly carries on or about his or her person a handgun in a
motor vehicle that is owned by the person or under the person's
control at any time in which:
(1) the handgun is in plain view; or
(2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor
that is a violation of a law or ordinance regulating traffic;

(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section
71 .Of.

Not a problem. I'm glad I can help. You came to the right place. Sometimes this forum is kind of slow on the weekends, but I'm sure many more who know more than I do will add to what I found, and hopefully not correct any ;)
 
You can buy handguns from other Texas residents in FTF sales. You can buy handgun ammo from any private party, Texas resident or not. You cannot buy handguns or ammo for use in a handgun from a licensed dealer until you are 21.
