Nebraska Concealed Carry: Lb454

Well, we are again trying to get a concealed carry law passed in Nebraska, one of the few states without. You can read it at < www.unicam.state.ne.us > type in 454 in the search box. The new bill that was introduced,( 454 nice round number, huh) is 15 pages long and leaves quite a bit up to the State Patrol as far as setting up the classes, requirements, etc. It is a shall issue bill, which is good, but there are a few things about it that concern me. On the other hand, it appears to actually strengthen the existing concealed weapons laws- minor change in wording in the clause that "IT IS" rather than it "shall be" an affirmitive defense that a prudent person blah blah blah. One of my friends has been arrested 4 times for carrying concealed and gotten off using the affirmative defense, arrests removed from his record even, but then he is an ffl holder with a good lawyer. The new bill specifically will not remove this and as I said appears to strengthen it. It also contains no wording that will affect our open carry rights.
If some of our experts in the field would take a look at it and let me know what you think I would appreciate it.

Does anybody have any opinions?

I kind of hoped somebody would look it over and tell me how it compares to their state or laws that they are familiar with.

454 is generally similar to the Colorado CWP law.

One interesting thing is that a permit must be revoked by legal action. In Colorado, the permit states it can be confiscated on the spot if an officer chooses.

It has the common prohibition on carrying in a bar. Colorado does not have that provision.

Not sure how it fits with other current Nebraska laws. For instance, in Colorado a handgun can be carried openly or concealed on one's own property or carried loaded and accessible in one's car for the legal purpose of self-defense. It is not considered concealed and no permit required in either case.
 
like I have said in the past this will not happen until the good people of Omaha vote out Ernie Chambers. the lottery is a better chance tonight
 
You have to get the people of your state motivated about this. That is the KEY. In Texas it cost a Governer (Ma Richards) her governership.

I was one of the few, very few Chiefs of Police in Texas who testified for the Concealed Handgun License before the State Senate and House Public Safety Committies. The Senator who represents my district was "Definately Against" allowing citizens to carry 45 Mags under the front seat of their cars cause Blood Will Run in the Streets when there is a minor traffic accident according to him. I so informed the TSRA and the NRA of the Senators feelings and they both did a mailout. Within a couple of weeks he had received over 5000 calls, emails and letters with only one from the Big City Chief of Police against CHL. Suddenly he was not only going to vote for the bill, he was now a cosponsor. Later I ask him why he changed his mind and he said that when he felt the heat, he saw the light.

If the citizens of your state will not support concealed carry, forget about it.

that Ernie's district is the one part of the state where most people of the state would feel the most need to be armed?
Actually, I don't know if Ernie is as big a problem as some of the other idiots that Omaha and Lincoln citizens elect. His main concern is and always has been his constituency and how legislation will affect the black community. Though on most issues before the unicam his opinion is totally irrelevant, at least he does make people think and be able to justify their positions. He has always been in favor of gun control as a means of reducing the crime in North O and will probably never understand that "an armed society is a polite society", or that swift, sure, and severe punishment will act as a deterrent to crime. There are others in the unicam that would totally ban firearms, and establish a total nanny state where they controlled everything if it was within their power. Ernie will be gone soon thanks to term limits, but there are other more liberal members that we will be stuck with for years to come. Heck they are even trying to get rid of the term limits, talk about nerve, they are trying to give themselves the power to completely disregard the will of the people as expressed by public referendums. They have tried to disqualify every petition drive in the state in recent years (except the ones sponsored by the casinos). Well, getting way off topic so I'd better get off now.
