Michigan Pepper-Spray Laws

I have spent some time in MI lately and was shocked to read on the packing.org website and the MI.gov law database that Michigan prohibits pepper-spray products of more than 2% OC and 35g capacity. I guess my 67g can of 10% spray is a no-go.

What are the penalties for carrying stronger sprays in MI? Would you pick up some kind of battery charge for using spicier gunk?

This is a strictly academic discussion, I don't break laws... even stupid ones. Do any reputable companies even make a 2% spray? It seems like the restrictions more-or-less ban anything useful.

What was the legislative intent behind this ridiculous statute? Were people being sprayed left and right and dropping dead from lung damage or something?
 
The funny thing is, that a lot of OC products "claim" 10% but in reality the amounts are .10%.
 
Thanks, Jim. I've got some Fox on the way for my next MI wanderings.

I looked over the regs again and noticed that the 35g restriction is only for CS gas. The only restriction on OC is the 2% deal so I was able to get a canister of acceptable size.

I'm still wondering what drove the fine state of Michigan to pass these weird restrictions. I talked to one of my friends in Grand Rapids today (he's a hotshot defense lawyer and law professor) and asked him if he knew anything about the OC law...

I can't repeat what he said because of all the 4-letter words, but he didn't have an explanation for me.:D

He did mention that using OC of greater than 2% concentration is a good way to pick up a battery charge (possibly aggravated battery) in a situation where use of force would have been otherwise justifiable.

Crazy.
 
So if one was to chew a Habanero pepper and spit it in the BG's face he will be charged with battery. :rolleyes: Food fight= battery. LOL This world we live in is a real circus.
 
Heck, we just didn't want all that pepper spray mucking up the atmosphere.

It's supposed to be "Michigun" :eek:

Just bring your CPL and firearm..... :D
