Marlin pump action .22 patent 1908

The action opens when moving the slide back. But it won't close unless I loosen the takedown screw. This is with tubular magazine and chamber empty. I was wondering if it only closes if there were shells in the magazine feeding into the chamber so I put some shells in the magazine but the magazine would not release any shells into the chamber.

I just acquired this rifle and don't know it's history.

Can anyone help me figure out what's wrong>
 
Jlbpa, I have one in the shop right now with the same problem. If you remove the take down screw and open the receiver, you can work the action and see what's taking place. What rubs against what etc. The problem with the one I have is that the rail in the left rear of the receiver that the bolt rides on or over was peened. A little judicious stoning cured this one now it's going through restoration. George
