Mail order ethics

Well, my smith finally received the G3 parts kit from InterOrdnance today. I thought I'd buy their "like new" kit and be on the safe side. Here's what a "like new" bore looks like to IO:

I waited 6 months for this sewerpipe looking thing. Apparently they reparked a pitted, shot-out, rusty, mess and added some new plastic to achieve "like new." You can't believe the anger. It's so bad, I want to laugh.

What are my recourses?

Misrepresentation. Seller makes a false statement on a material fact (something which the parties consider important to the contract) with intent to induce Buyer to buy, and Buyer, relying on this misstatement of material fact is indeed induced into the contract. I would venture to add that the defense of "puffery" (salesman's inflating the virtues of the product) cannot reconcile the distinction between "like new" and "sewer pipe" by any stretch of the imagination.

First, call and complain and follow up with a written letter of complaint (leave a paper trail). If you don't get satisfaction and you're in the same state, see if your State's Atty Gen. has a Consumer Fraud Unit. If you're in a different state, check if the Inspectors of the Postal Service will help.

Caveat Emptor - "Buyer Beware"

Two buddies an I went together a bought four Stg58 FAL kits from InterOrdnance last year. First, the ad in Shotgun News said they'd come with two mags, but they only came with one. Second, they were suppose to be "hand select", three were well worn but acceptable (because of the chrome bore & chamber they shoot great) but the fourth was missing parts and looked like it had been dragged from Vienna to Salzburg on cobblestone roads behind a donkey cart. We finally got a refund on the fourth FAL but it took about 3 months, a lot of phone calls, BS, and the direct involvement of UPS before we got credit back. Document every conversation with them and always pay with a credit card (not a debit card, which was the mistake my buddy made). -- Kernel
