MAADI Kit Confiscations??

I got an email from someone that forwarded something from the Militia of Montana to me.
The gist of it is that ATF is going to be going out this weekend and confiscating all of the kits from people on Stewart's mailing list.

Any idea if this is fact or fiction?

At any rate, it would seem that the ATF would at least need a warrant, stating that they had evidence that the kits had been assembled before they could confiscate, but who knows?
Maybe the fourth ammendment is as dead as the second...
I don't have one of the kits, they looked too cheesy to me, and I lost interest as soon as I saw them. Others obviously do have them, and forewarned is forearmed.

What law would the people who have the kit guns be violating?

It is legal for them to own them. The only problem is whether it is somehow illegal for them to have purchased them from Bob, who is an entrapped felon.

I hope Bob has a phone tree set up. One that can reach 3,000 people in short order.

I wonder if I will be on that list since I am running the rifle raffle.

it seems to me that step one would be a registered letter to the list requesting the kits be logged in via an FFL

If I remember correctly, these were sold inoperable, without serial numbers and some machining is required to make them useable, right? If you performed that modification and transformed this inoperable "weapon" into a working .50 BMG, wouldn't you then be required, by law, to get a BATF serial number?

If the answer is yes, then the BATF could be going around checking the names on the confiscated list that haven't requested a serial number. And if they find any that are operable, then ... isn't the possessor vulnerable to legal action?

Of course, we also know that the BATF doesn't know how to determine that the rifle is operable. Remember the courtroom drama where the BATF explained to the judge that they fired a primed case, without powder or bullet and therefore determined that it was an unnumbered weapon? What a hoot.

I just spoke to Bob S. personally while he was on the " Lady Liberty " show on KKVV radio in L.V. and he says that that rumor did not come from or through him. He has no way of knowing what the batmen are up to, any more than You or I. Whether or not the M.O. M. has any pipeline into the feds, I have no way of knowing, but am doubtful.

I beleive he got busted because a kit requried less work to make functional (by a fully equipped, experienced, gunsmith, I'm sure) than the current interpretation of a code. They at that time declared his kits to be firearms. That would include the kits not in his posession. The ones who put them together and registered may be safe, but in times of legal interpretation, not sure about anyone else.
