loaded shotguns in vehicles?

Since Kansas ans Missouri don't have concealed carry laws can you legaly carry loaded shotguns or rifles in your truck? thanks i have my chl for texas,but when I retire in 5 years and my wife wants to move back to her home state(kan) I was trying to come up with an alternate way of protection. I don't forsee them passing a chl law. sj

I've researched Missouri (not Kansas)state law quite a bit and can't find anything prohibiting loaded shotguns or rifles or handguns in vehicles provied they're not concealed. It in Missouri Revised Statutes chapter 571. You can get access to all of this by going to the searching the state's legislature site. The NRA site will give a good SUMMARY of this. You should be warned, that some cities or towns might have ordinances against openly carried firearms. There are only two things local athorities can prohibit beyond MO state law, open carry and firing in city limits. Good luck on trying to find out such information. When contacting Sheriff and Police departments, don't be surprised if they give you the wrong answer (they don't necessarily know the law). Most likely they'll say "no you can't do that" either way. There are exceptions to the ban on concealed carry in Missouri. One is "traveling peacably throught the state". Read MO code 571.030. I don't recommend actually doing it. It can result in trouble, arrest, etc, then you will have to prove yourself innocent in a court that probably won't care what the law is. Even if if a court would dismiss such a case, you could have still been "arrested" at some point. Remember, we live in an age when the meaning of the word "is" is questionable. There is no state law requiring things to be in locked cases with the ammunition in a separate area. Such things may be practical in many cases to avoid trouble, but ARE NOT required by state law. Hypotheticly, if you had a pistol in a case with a loaded magazine (not inserted in the pistol), that would be fully legal in Missouri, or a loaded shotgun or rifle. I'm not suggesting you do it. That's all based on my own reading of the statutes and the fact that I consider myself functionally literate. A liberal court will interpret things to mean whatever the hell they want. Say a person did this, was arrested by an ignorant LEO and got his day in court with a liberal judge and a jury with a bunch of MMM types on it (never mind that we're supposed to have a jury of our "peers"). Furthermore, although open carry is lawful in most places in the state, do it an count on being harrased. The Missouri State Constitution also states citizen's have the right to possess arms not only to defend themselves, but also their property! If no one believes me, look it up. Would a prosecuter charge someone with a crime for doing so? You better believe it. Would a court convict someone? You know they would.

I would not suggest anyone break the law, but hypothecally, if one was to carry concealed in a place where such an act is unlawful, how would he ever get caught if it was truly concealed? No one would be able to see it. If someone did, it would not be concealed. If it was ever truly needed, it would be in a life threatening situation. At that point there are not a lot of other options, and most reasonable people would realize their life is more important to them than some STUPID law.

I guess I've babbled on long enough on this. I've gather a bunch of information and have attempted to list all actual MO state statutes concerning firearms. It's several pages long, so I don't want to post it here. If you're interested, I could email.
