Legal Question from Calif

Does anyone know if this would be legal in Calif? My father in law lives part time in Arizona, he has a Colt Python .357 6" blued. The only Colt Python which can be sold in Calif is the 6" Stainless, 6" blue is on the list that hasn't been for testing. Now, if he brings the gun into California, he has a house in California, and gives it to his daughter (my Wife) then she in turn, gives me the gun. Would this type of move be legal? He is in his late 70's and he will leave the gun in his will, but he thinks it better if we possess the gun before his death. How can we make this type of transfer happen? I was reading somewhere that a parent to child transfer can take place between private parties even if the gun is on the unapproved sale list. The Colt is not on the list for sale in California, the 6"blued is not on the approved tested list but the 6" stainless is, go figure!!!!Thanks for any and all information.:rolleyes: ;) ;)
 
Guns can be transfered from parent to child, about the gun itself I don't know. And your wife can not transfer it to you. You will need to do that through an FFL. If the gun isn't legal in CA leave it in a bank lock box in AZ if you realy want it, then you can figure out what to do.
 
I don't think that private party transfers are subject to the "Gun has to be on the approved list" phenomena in CA. The approved list is for dealers only (AW excepted).

Transfers from parent to child, as well as spousal transfers, are exempt from dealer requirements (background checks and waiting periods). Both of these transfers are what is referred to as "Operations of Law" transfers. In CA with the transfer to your wife, you will legally own the gun anyway because of COMMUNITY property. For the parent to child transfer, she MUST have a Handgun Safety Cert.

To follow the rules to the letter, both transfers must be reported by filling out the DOJ form and paying the $19 fee within 30 days. However, she can just "loan you" the gun for any legal activity. I would just insert a time delay between DOJ transfer to your wife and then to you.
