Legal question about an SKS

I need some info. about BATF regs. on an SKS. I bought an SKS a week ago and want to know if I can install a folding stock on it.

I've heard that the date of import is what is the determining factor. I have no way of knowing the date.

It is a Norinco I think. The partial serial # is 1408XXX if that would help. I got a good price on a folding stock at this weekends gun show. I don't want to become a felon and loose my CHL over a folding stock.

Any help would be great.

Stay safe and keep it full stocked. I'd be very leery of a "date of import" being the factor that would keep me out of jail.

Also folders really, really, suck.

AFAIK, under Federal law, the folding stock business applies to "semi-automatic assault rifles" which, by definition have detachable magazines. Since the SKS (unless modified) does not have the capacity to accept a detachable magazine, it is not an assault rifle and you can put any type of stock on it as long as overall length is kept over 26 inches.

You can call BATF if in doubt.

I agree with swampgator that those stocks are pretty useless; I suspect an attack of the "Iwantacoolgun" virus coming on here.

I just sold my SKS with a folding stock a few days ago.

I actually had a great use for the folding stock - I lived in a area that was 'sensitive' to firearms. Carrying a case from my room to my car that was obviously holding a rifle was a bad thing. The SKS with a folding stock would fit very neatly into a regular gym bag and cause no suspicion at all.

That said, I never had a problem aiming the rifle or shooting it with the stock, and it's just so much fun every once in a while to blow through the magazine with the gun at your hip like Rambo.

FWIW..

If it's all original, putting the folder on it would qualify it to comply with the 89 imports' ban's parts count.

I wish I could pretend that I remember what the count is (I think it's some sort of percentage), but it's been awhile, and I can't.

BTW - if you call the ATF, you know what they'll say without having to ask. They're nice guys to deal with until you tell them you bought a gun privately or put a folder on a rifle.

Folding stocks are for gun shop commandos and Hollywood or the rampant "Iwantacoolgun" virus.

Jim, the cure for this virus is to actually use it. A lot not just two mags at a water heater.

It is illegal to do. The Federal Firearms Referance Guide uses an SKS w/folder as an example its says that it would not be governed as an assualt rifle if it has a fixed mag,but it is illegal because one has created a firearm that would not be imporatble under sec. 925d(3) and 922r you would have created a weapon that would be banned from import using 10 or more imported parts.
