krinkov parts kits

If one were to build, or have built, one of the krinkov parts kits available now would one need: preban receiver and SBR tax stamp or standard new receiver with SBR tax stamp?
I'm thinking about buying a kit or two for later construction.
Semi auto only. I guess the folding stock
couldn't go on a post ban receiver.
 
I don't believe SBR has any effect on pre/post ban guns other than the barrel length. Is the "flame extinguisher" typically found on Krinks considered a flash suppressor or a muzzle brake by the BATF?

If you build on a post ban receiver, you could always pin the folding stock open an use it for looks only.
