Edited, because somebody thought my response was "not nice." Let me rephrase: If a liberal justice dies, and Bush gets to appoint the replacement, then a conservative swing-of-balance could be achieved. Better?

Now if ol' Pruneface or Souter dies, then the balance might change.
Not very nice things to say, to say the least.

As far as I know, Ginsburg has cancer (colon cancer in remission, I think), and Stevens is getting up there in age. If I had to guess, it would be Stevens retiring when this term is up. Ginsburg will wait until next election, hoping for a democrat to be elected, IMO of course, unless her health takes a bad turn.

I could not believe Alan Dershowitz' comments on FOX. He called Renquist a "Republican Thug" and judicial activist. Then he brought up all the "dirt" that Renquist sailed thru over 30 years ago....including the fact that (predecessor) covenants on his home precluded ownership by Blacks and Jews. He went on to explain that "activist" means someone who fails to side with the Congress. Go figure.

Even Andy Napolitano, generally the voice of tact on FOX, was absolutely appalled, and said as much.

WA-
Yup, up late. Put Doggy Dog on hogs this afternoon. Came home. Took nap. Woke up 6 hours later. Musta been a long week!

Was about a quarter inch from commitment to your part of the world a week ago when I finally canceled a Brown Bear hunt opportunity for the 20th because the outfitter just didn't have his stuff together. Next time.

Another late nighter.

Guess we're all up late tonight.
I just saw the story on AOL News. I was pretty sure someone here had beat me to posting it.
While I haven't agreed with some of his decisions, he did have a very active and productive career.
It's a shame his death comes on the heels of so much turmoil within and about SCOTUS. In particular the delayed Senate confirmation of John Roberts and the Kelso decision.

This just shows the level that some people will go to in order to gain a bit of notariety. I only hope that the Rhenquist family is not subjected to much more of this type of uninformed dribble.

God rest a decent man.

out of curiosity, is there any good reason for this to be a lifetime appointment? seems such an important position should be voted on like every other important government office

"out of curiosity, is there any good reason for this to be a lifetime appointment? seems such an important position should be voted on like every other important government office"

It's a lifetime appointment precisely because that way the judges don't have to care what the voters think. In theory, that way they will do the right thing rather than simply the popular thing.

I agree with Rich Lucibella. Dershowitz's comments on Fox were way over the top. Why is it Republicans are the ones called mean spirited, but it is the left that seems to REALLY spew hatred?! Dershowitz should be ashamed of himself. When one of the other lawyers(Levin) called him a "jerk", he was RIGHT ON TARGET!

It's not suprising that the liberal/left is spewing this kind of poison. They have become morally and intellectually bankrupted, without any kind of positive agenda or vision. Their last stronghold is the activist judiciary, now they see even that slipping away, and it's driving them crazy.

Expect it to get worse, a lot worse.

That certainly makes sense. I assume the president and congress have some ability to remove a judge, correct? What reasons would be required? Has it ever happened?
