Judge dismisses lawsuit against gunmakers sued in accidental shooting

(10-14) 14:30 PDT BALTIMORE (AP) -- The families of two boys who accidentally shot themselves in the head will appeal the dismissal of a lawsuit against two gunmakers and a gun store.

The lawsuit, filed in July, claimed the defendants were responsible for the two shootings because they failed to make the guns childproof and failed to warn buyers of the dangers posed to young children.

Gunmakers Sturm, Ruger & Company of Southport, Conn., and Lorcin Engineering Co. of Mira Loma, Calif., as well as On Target, Inc., a Severn, Md. gun distributor were named as defendants in the suits.

Baltimore Circuit Court Judge Evelyn Omega Cannon said Wednesday that a childproof device on the gun would have saved the life of 3-year-old Jordan Garris, whose family sought $6 million. But failure to install a childproof lock did not make the gun defective under the law, she said.

``It's also clear that the child's father knew this was also a very dangerous product,'' the judge said.

Defense attorney James E. Gray said the boy's father, Cliff Garris, was negligent because of the way he stored the gun, a misdemeanor under Maryland law. Jordan found his father's handgun hidden under a mattress, loaded it and shot himself in the right side of the head on June 6.

The lawsuit also sought $1.25 million for the family of 8-year-old Nino Jacobs, who accidentally shot himself in the head two years ago and survived.
