Is Removing Plug Legal?

I just bought a Marlin Cowboy II in .44 & it comes with a plug installed that gives it a 10-shot max. magazine. Is it legal to remove this plug & turn it into a 13-shot? The plug simply falls out when the magazine tube is pulled off.
 
But maybe like you imply...it doesn't apply to magazines that aren't detachable - as long as you don't live in California, that is.
 
Should be legal as it's a lever action rifle and not a semi-automatic with "detachable ammunition feeding device".
 
Like these guys said, it's not generally illegal to increase a tubular magazines ammo capacity. The law says that post ban detachable mags can only hold 10 rds, a tubular mag can hold as many as you can get in there, unless it's a semi-auto shotgun, which it ain't. So unless your local laws prohibit 10+ rd tube mags, then it's perfectly legal.
 
I'm thinking CAS has a 10rd limit in thei rules and the plug may be a courtesy to keep a shoot participant from miscounting and disqualification. Not all types of participants may have the ability to disassemble and install one of these.:)
