Instant background check!?

I have bought three hand guns in the last 3 months.I live in Texas and the seller is supposed to be able to pick up the phone and call the FBI to get an instant reply if you are legal to buy a firearm.On my fist attempt I waited about 2 hours and was told I would have to check back in a couple of days.[I told them to forget it]The second attempt I waited 5 hours with the dealer calling the FBI every 30 minutes untill the dealer said it went thru and sold me the gun??????3 days ago I filled out the paperwork for another handgun and have waited for the FBI to give me an ok.Legaly the dealer can sell me the gun if he has no reply after 3 days.He said the had me on "delay"What does that mean?Well tommorrow I will pick up the gun without hearing from the FBI if I am legal or not![tommorrow will be 4 days]Doesnt make sense to me.Has anyone else had problems of this nature?

When we used to sell guns in our pawnshop the instant background check was anything but instant. When we did the check we would call the state police, not the fbi. You are right though, after three days if we didnt hear from them the person could keep the gun. I do remember once we got a call from them about a week after we sold it, the guy walked with it after three days and then 4 days later the state calls us and tells us not to give it to him. We told them we did and they didn't really seem to care for some reason. Really strange, the guy is a security gaurd at a big mall. Kind of funny, as far as I know he still has the gun.

You should know if before the check if they would refuse you. If you haven't committed any crimes I assume you would be legal.
 
mamor, since you live in Texas, if you'll go get your chl there won't be a background check.

Thankfully, I've never had a problem. Everytime I've purchased any firearm, even at a gunshow, the check has been done and I walked away with my purchase. I'm in Dallas, clean background, etc. I'm always sorry to hear that others have delays.

I've made ten purchases since this madness bagan and have been delayed every time ranging from 30 minutes to two days. I always give me SSN even though it is not a requirement for NICs to help expedite things.
Mamor the dealer that told you to check backin couple of days was a fool. He should have at least taken your number and stayed on top of them to approve the check and then called you. Given the circumstances I may have told him the same thing and then gone elsewhere. However by telling them to forget it you have given the antis what they want. You simply did not get a gun that you wanted and the bogus NIC check was affective in it's true intent, which is to inconvenience gun owners and take guns out of our hands.

I have never been approved instantly. Every time I get a new weapon I almost without exception get to pick it up a few days later. The best that my dealer and I can figure out is that I was born in CA and now living in KY, it seems to throw the system for a loop. So I guess that I'm part of the 150,000 (or whatever # Bill is throwing around these days) of people denied a gun, and like criminals I too am able to get a gun anyway after being denied (it just takes me a few days of waiting for the system to figure itself out rather than going to the nearest corner and buying a stolen one).
 
Only ONCE have I been approved right away. And it was on 2 rifles. Virgina what a great gun state. Here in Anti-land(maryland) I get delayed everytime. The first time it took 3 days, now it is about 5 minutes unless it is a evil gun(handgun or assualt rifle)Then I have to wait 8 days and then I am "not dis-approved." I was also told that if you have a clearance that this holds the process up, Now I thought I wasn't suppose to say I have a clearance and is that attached to my social?

From my own experience in Pa., the only real delay is if someone is ahead of me in the store. I was told by one gun dealer that sometimes it takes a day because the system was busy. My last handgun purchase was between Christmas and New Years. You know, Y2K panic week. No I wasn`t one of those. I bought a gun from a friend and it was the only time I could do it. There were a couple of people ahead of me and all told it took about half an hour. Again, I only can speak for myself.
 
Here is a problem that I have noticed with the Instant Check. The system looks for people who have FBI Records. But every Police officer and Military type who had a security clearance (active duty or out of the service entirely) has a FBI record. The system seems to have trouble picking those of us who have a FBI file because the goverment has examined us 50 ways from sunday apart from the crooks. So cops and x-military types can get delayed because the government has judged us as trustworthy. GO figure.

Because the Virginia State Police BG check computer is directly connected to the Federal check system, it is pretty quick in VA.

I saw a guy with a clearance go through this a couple of weeks ago in a store in VA. The store was doing the check via computer and got a "hold until called by State Police" report, along with a notice that the fellow was clearanced. The guy was hacked, and about to leave after thirty minutes had elapsed, but the "ok" phone call came in. Apparently either the state police or Feds notify whoever issued the clearance when the background check is done, so they can know this sort of BG check is happening.

It's funny. My old social security card states that it is illegal to use my social security number for identification. Has that changed?

Avoid the registration of your firearms by purchasing them from private parties. The only thing that NICs and the form 4473 get you is instant registration.
 
It is Illegal, but that hasn't stopped them from using it. Does "no controling legal authority" ring any bells?
 
I got delayed once last year, and after 3 business days, actually it was 5 or 6 days including the weekend, the dealer gave me the gun. The dealer never heard back one way or another. Now Colorado uses the state CBI system and have not had a problem since with a few other purchases. I don't know what the deal is.

Local preacher man got "delayed" last week. He is the firearms safety instructor and his jaw about hit the ground when the dealer said he couldn't take the gun he had custom ordered home. Also you can't have the dealer "pre call in" before the gun AND the customer is in HIS shop. I have bought from same dealer guns that I order and he CAN'T use my old 4473 to pre approve me before I drive the 50miles each way. Yep this prevents a lot of crime. Local Ducks Unlimited gun winner was delayed, finally he had his wife buy it, She passed in one call. They called back 4 days later and approved him. "both gave full name/address/SS##
