I am 18 and live in NC i know that I am not old enough to buy a pistol (must be 21 in nc) but if i get pulled over with a handgun in my car or just get caught with ti in general is it illegal for me to have it?(note that i have permition from the owner to shoot it)
 
I may be wrong but I think that somebody 21+ has to at least be present. At least that is what I was told when I was underage.
 
It depends on your state laws. In many states you must be 21 or older to purchase a handgun or ammunition, but you may be in possession of a handgun at the age of 18. I'd say do a google search for your state's handgun laws. Don't trust any site that doesn't end in .gov.
 
I cant think of of a state where you wouldn't be in a whole heap of trouble. Maybe somewhere like Alaska, Maine or Vermont might be different.

Here's the statute. In NC you would be arrested if under 18 yrs old. If you are 18 or older it depends on if it was concealed in violation of the CCW law or some other violation.

14‑269.7. Prohibitions on handguns for minors.

(a) Any minor who possesses or carries a handgun is guilty of a Class 2 misdemeanor.

(b) This section does not apply:

(1) To officers and enlisted personnel of the armed forces of the United States when in discharge of their official duties or acting under orders requiring them to carry handguns.

(2) To a minor who possesses a handgun for educational or recreational purposes while the minor is supervised by an adult who is present.

(3) To an emancipated minor who possesses such handgun inside his or her residence.

(4) To a minor who possesses a handgun while hunting or trapping outside the limits of an incorporated municipality if he has on his person written permission from a parent, guardian, or other person standing in loco parentis.

(c) The following definitions apply in this section:

(1) Handgun. – A firearm that has a short stock and is designed to be fired by the use of a single hand, or any combination of parts from which such a firearm can be assembled.

(2) Minor. – Any person under 18 years of age. (1993, c. 259, s. 1; 1994, Ex. Sess., c. 14, s. 5; 1993 (Reg. Sess., 1994), c. 597, s. 1.)

You need the section, if one exists, that deals with persons under 21. Your not a minor.

Call your states AG's office and ask.
 
Here in IL if you had a handgun in you possession of a firearm, but we also have a FOID card act here too. You must be 21 and have a FOID in order to possess or transport it here. From what I've read NYC isn't much different than Chicago as far a gun laws go. Here you would be arrested for unlawful possession of a firearm, and the owner could be in trouble for allowing you to have possession of the firearm!!
 
the easy answer is Don't do that.

take the owner with you.

it would be a lot less hassle if you get stopped.

and possably lead to you NOT being a felon before you turn 21.

I read that law posted, all you gotta do is get yourself emancipated! Maybe the president can proclaim you emancipated. Would look good on his legacy, he emancipated someone! :D

It probably doesn't seem that gray to the law. As a matter of fact, I'm betting they have some pretty darn solid ideas about it. I'd suggest you find out what they are before you do it.
 
In some ways we (Canada) have nicer gun laws then some of your states. EVEN thought were not aloud to take a handgun in the bush, I was able to buy one when I was 18. Iv taken my non restricted and restrcited firearms license allowing me to have hunting firearms like rifles shotguns and pistols and miltiary ar rifles, nothing fully autmoatic though like you guys can get ahold of in the states. and theirs a legal barrel lenth on pistols. Im 20 now and only have two pistols but its werid, were aloud to PURCHASE firearms legally at 18 but we cant go out hunting until your 19 or with some one 19 of years of age or older. Lol dont ask my why, I just follow the rules :cool:most the time. I know this is FAR off topic but the legal drinking age is 21 their too? our countrys are very different but similar at the same time. here its only 18 in some provinces and 19 in others. anywho Iv babbled long enough.
 
Here in NC , 18 is not a minor although he must be 21 to purchase a gun. As the NCGS above states he can possess it. However, if you carry it in a car it should be locked in the trunk or in plain view on the seat or dashboard so that an officer sees it without any problem. (Don't wait to put it out somewhere as an officer approaches or be making a lot of movement however, as that will immediately raise suspicion) So until you are able to get a CCW permit the trunk really is the best place in my opinion. As an oficer myself, if it's not readily in view when I approach your car you are just asking for a problem.

Kind of a side question here. If you move into NC from out of state, do you need to acquire a handgun purchase/possession permit if you already have the handgun, or is it only for new purchases?
 
So i went and read the actual NC handgun regulation paper and it says that under 18 you cant posses it but it dosent really say anything about 18 ro older being able to have it....Tleo your a law enforcment officer......you said i would be in the good if you were to pull me over?
 
Think of it as a bag of drugs or something. If you have it on your person, in your car, in your bedroom, so one and so forth, you are in posession of it.
 
As best as we can ascertain at this point, hes allowed to be in possession of it over 18.

In PA its legal for anyone 18 or over to own and/or possess a handgun. You can actually buy the gun from an individual too, just not from an FFL. You cant get a carry permit until your 21, but you can get a provisional permit to carry one while hunting.
 
As a rule of thumb, if you can legally owe it then you can legally have possession of it. Since you can not legally own it you will be in heaps of trouble if the cops wanted to make it for you.
