Just thinking about this today. Clinton and Reno DON'T want any of this in court. If it goes in front of a judge the media will pretty much be forced to report how there really was no Federal Order to seize Elian (except in Clinton/Reno's head) and how the whole "enforcing rule of law" argument was pretty much a lie.
Add to that that it's pretty obvious Clinton is bending over backward to appease Castro for whatever reason and Fidel definitely wants his little subject back (old habits die hard, I guess. Clinton has been trying to impress Commies with his generosity since day one). No way these world leaders are going to risk a court decision that would give Elian a shot at asylum.
I think Elian has to go back before any kind of real trial, in Federal or State court, lest the whole house of cards falls down on Bill's head. I think one day in the near future Elian and his Dad will simply be seen on Havana television, smiling and kissing Castro's ass, without any announcement of his being returned. Clinton will make some kind of speech about how it was the right thing to do, yadda, yadda, rule of law, yadda yadda, Executive Privelege, yadda.
If this does happen, and you happen to live in Miami, get ready, 'cause it's going to be a hot time in the old town that night!
