How do I legally sell a pre-ban high capacity magazine in California?

Hi folks,

This is my first post on TFL. I hope you can help me with a question.

I was cleaning out my closet when I found a pre-ban, high-capacity (15 round) magazine for a SIG Sauer P-226 pistol. It was a spare mag from the good old days and since I have long gotten rid of my SIG, I don't have any use for the magazine. It is a SIG Sauer factory mag in excellent condition.

If there is a legal way to get rid of it, I'd love to sell it to someone that could use it.

As near as I can figure, the only "legal" thing to do is to take it to another state and sell it. I'm in the same boat. I have a handgun I'm really not using that I'd like to sell, but the mags are all over the ten-round limit.
 
I'll second that. Skate accross the border into AZ and sell it there. :)
 
I bought a 13-round USP magazine from a fellow in L.A. a few months ago, and he shipped it to me here in TX, but it would be illegal to sell a 10+ magazine to anyone in CA.

It's illegal to ship any more hi-cap magazines into California unless such shipment is to LEO or their agencies. As for in-state magazines which precede the California ban, I believe it may be freely sold here. Shucks, I'll have to check the CRPA gun law booklet now.
 
It cannot be sold or transferred within California. You can sell it to a resident in another state and mail it to them. Post it on an auction site and you should get a buyer.

I live in Oregon.. come meet me neighbor (in Oregon).. I'll gladly buy it. Sure, I don't have a sig... yet. As for you Gorthaur, what type is it? If you live in PRK then bring it up to Oregon.. I will gladly buy it. (Tell me the prices first and I'll see what I can do. Then, I'll meet you at the State border (PRK/Oregon) if I am interested).

I believe, technically, one needs a high capacity mag dealers permit from CA-DOJ to be able to sell to out of state buyers from within the state. That's why CA businesses are still selling to buyers outside the state, but can't sell to CA residents.

Otoh, how are they going to know about a one time private party, out-of-the-state transaction, right? Unless it was some sort of sting... However, it might be a good idea to move any such business off-line. You never know who might surf by and read the posts...

The permit thing is probably more of a concern if you do this for a living, run ads, sell on the Net/mailorder, etc.
