Home invasion question

Suppose you have a home invader, armed with a gun that surprises you and your wife (6 year old daughter asleep in her room). He has the drop on you and you cannot grab your gun and shoot. Further assume that the invader briefly turns his back to you and you are able to draw and shoot him. what would be the potential legal repercussions might occur from shooting him in the back.

Personally, I would take the shot. He is an armed invader threatening your family.

What do you guys/gals think?
 
The legal difference would be whether he is turning to leave or simply making an error in judgement or being distracted by something.
If you are in serious fear of imminent bodily harm then the law does not require that the BG is facing you.

I think it depends upon the way your state laws are written, and without knowing your state of residence, no one can comment on the legality of the shoot.

As far as the morality of the issue.... I think it would be immoral to not shoot the intruder.
