help: Muzzle brake or flash hider?

A friend took this on trade a few years ago and didn't notice the thing on the end. Is it a (legal)muzzle brake or (Illegal )flash hider?
How do you tell the difference. He'd like to sell the rifle, but dosne't want to sel it with flashhider. (the rifle was built after 94)
 
Purely opinion: I would argue that it is a muzzle brake, because the forward edges of the holes provide surface for the forward motion of the gases to push against, thus reducing recoil.

Further, the holes themselves direct the flames outward, if anything *increasing* the "signature" of the muzzle flash.
