Help! Absolutely confused about CCW law!

Hello fellas,
I am beyond confused. I am hoping you fellas can help me. I live in Michigan where obtaining a CCW is very difficult (depends on whether sheriff likes you or not). Michigan and Florida are reciprocal states honoring each others ccw holders. Florida is a shall issue state and offers non- residents ccw permits. If I cannot obtain a CCW through Michigans stringent guidelines, but can obtain a Florida CCW (under shall issue), can I carry concealed in Michigan with Floridas permit?? I have been trying to figure this one out for a couple days, I do not want to call the Michigan State Police for I fear the officer I talk to will tell me not possible before that officer researches all the legal mumbo jumbo that I have been trying to sort through. I know that people in Colorado are obtaining Florida CCW permits so they can carry concealed in surrounding states, I am wondering if the same applies here in MI. All I want to do is protect my family and stay legal(should not be so hard). Long live the 2nd. Huntnut
 
You need to check with:

1. A Michigan attorney; or
2. Michigan government agencies; or
3. Some other independent information source

to find out, under Michigan law, which states they have reciprocity with, if any. The answer is PROBABLY NOT, if Michigan is a "discretionary" state and Florida is a "shall-issue" CCW state. In that case, since the Michigan requirements are more stringent (i.e. discretionary approval based on "need", etc.) than Florida's (an objective list of mininal requirements), Michigan would probably not offer reciprocity to Florida permit holders. That's not to say that you couldn't obtain the FLA permit and carry when you're down there, as well as the other states with whom Florida has full reciprocity, but as for it allowing you to carry there (MI), maybe but I doubt it. Let's see, wasn't there a website with the reciprocity info on it.....?

Michigan is freakin' BIZARRE.

Yes, they're discretionary. But they DO recognize out-of-state shall-issue permits. Unless the out-of-state permit is held BY A MICHIGAN RESIDENT.

I've said for a long time that failure to honor reciprocal permits probably falls afoul of the 14th Amendment "privileges and immunities" clause, whereby people can't be screwed by a given state based on being from out-of-state. But in MI's case, it's backwards: FL residents with an FL permit get to pack, while MI residents with an FL permit are screwed. MI screws their own residents. Dunno if that can be challenged in Fed court as a violation of equal protection...certainly seems worth investigating.

The other avenue is to figure out which MI residents score, and who doesn't, and make equal protection claims based accordingly. This is much less radical; if people are scoring based on campaign contributions, wealth, social status and the like it's an equal protection violation from hell. Especially since the law can be proven to have a strong racist origin. There's Fed-court equal protection support in discretionary CCW from the 9th Circuit in Guillory vs. Gates, I suggest reading that at my site. Read my "Contra Costa Cronies Roster" for an example of what you can do once you have documentation on who's successfully applying. I'm filing my second lawsuit soon, and I'm gonna kick my Sheriff's arse up one side of a courthouse and down the other with stuff like Guillory and his clear pattern of biased issuance.

I am afraid you're "out of luck". I just checked the www.packing.org web site; it is probably the best source of CCW information available.

They indicate that Michigan recognizes only Florida RESIDENT permits. Therefore, a non-resident Florida permit would not be acceptable. Further, the www.packing.org data states that Michigan does not accept any non-resident permits, which suggest that the only legitimate way a Michigan citizen can carry concealed is with a Michigan permit.

Sorry to convey this bad news. Please check this information further with Michigan legal and law enforcement sources. I am not an attorney and I certainly am not familiar with Michigan law, however, I have found "packing" to be comprehensive and accurate.
 
MI only recognizes resident permits, regardless of the state of issue. Period. It's not that they're discriminating against natives, at least in theory. So I can..., I mean may (I can carry in DC, Chicago, or New York), and do, carry a pistola when I go there, but most of those around me can't.
