Hawaii layover during transit

Hi folks, 7/6/12

I have a one day layover in Hawaii in August. I'll be staying overnight at one of the hotels. Is there any special procedure I need to know in bringing my Sig P-245 through Hawaii? It does not have a mag greater than 10 rounds so I should be OK in that regard. I tried Hangunlaw.US but clicking on the Hawaii icon didn't get me anywhere.

Hawaii is reputed to be as rabidly anti-gun as New York City. I would tell the airline that your checked bag contains a legal firearm, which you are not allowed to have with you in Hawaii, so the bag is their responsibility until it reaches the final destination. Carry a toothbrush and a change of socks and underwear in your carry-on.
 
I know this isn't really answering your question, but where are you going that Hawaii is on the way?

Taking pistols on international trips can be legally problematic...
 
Unless you have made prior arraingements to legally posess your gun in Hawaii, I strongly refcommend that it stay in your luggage, and that you NOT claim your luggage in Hawaii.

there was a fellow a while back that due to a mechanical problem with his plane, was put up by the airline overnight, in New Jersey (IIRC). He had legally checked guns in his luggage. As soon as he claimed his luggage, he was in violation of NJ law, and was arrested.

Even though he should have been covered by the FOPA, it didn't matter to NJ, and he was arrested, his guns taken, etc.....

I believe that after some months of legal wrangling, and considerable expense, he finally did beat the charges. I don't recall if he ever got his guns back.

Strongly recommend you do what is necessary for you to avoid the possibility of a similar situation.
 
you must contact authorities if you are in hawaii for 72hrs when having the firearm...under that you do not.

the kicker is though that you have to have a substantial, valid reason to have a firearm for that to come into play. (examples only: you are an off-duty LEO, you are on official business and that is why you have a firearm, etc).

Guys, if he is in travel to somewhere can he just not say anything since his baggage(if checked baggage) is "in travel" or "in transit"?

I am asking because I have heard different things regarding this as well as some horror stories with other states regarding the same situations. That is also a good question if he/she should alert the plane staff as the first reply post mentions.....

John- I live in one of the US territories west of Hawaii and transit through Hawaii once or twice a year with my carry weapon. Going through Hawaii to the States you have to clear customs through TSA before reboarding and this has been no problem. Coming back it is checked straight through to my destination so I only have to clear customs back home. No problems with 10-15 trips so far.

A few years ago I did an overnight stay in Hawaii and remember the three day rule that said if you were staying more than three days you had to do some clearance or declaration with HPD. That was a while ago and would like something in writing I can refer to in case of any problems in Hawaii. Maybe I should shoot an email to Gary Slider at Handgunlaw.US for his opinion. He has been helpful in the past.

I live in Hawaii. Gun laws are bad, but not as bad as New Jersey or California. You can have your guns with you and don't have to register them with Honolulu PD unless you are here for more than 72 hours. No concealed or open carry allowed unless you are law enforcement (then there are other proceedures for that). No assault pistols or pistol magazines that can hold more than 10 rounds. No teflon bullets (I"m not kidding). You can only transport your gun between your residence, sojourn, gun shop/repair, range, work, and a few other places. We do have alot of car thieves that target tourists, so watch your belongings.

I am just curious because it did seem that LEOSA is frowned upon in HI. once again it is curiosity, but they can't hassle or add procedures for offduty LEOS(native and tourists) carrying under leosa right? I had looked a few yrs ago and it did seem there were 'other procedures' as you mentioned but the federal law is clear and concise
 
Back when the law came out, Hawaii didn't want to follow the LEOSA, then they recanted but put all sorts of restrictions for on/ off duty/retired law enforcement to carry. Not sure what the policy or procedure is now. But they have this on their police webpage:

Note: There is no compact agreement between Hawaii and other states that would permit police officers on official assignment in Hawaii to be armed and exempt from the provisions of the Hawaii Revised Statutes relating to firearms.
