Handgun at 18?

Well, I live in Texas and age 18 is fast approaching. The way it's been explained to me, it's legal for your parents to give you a handgun as a gift or to buy one in a face to face transfer at age 18, but you can't buy from an FFL until 21. Why is this? Doesn't make much sense to me...

As far as I know and as much as I've read about it I think you can legally possess a handgun at age 18 but not carrying, obviously, without the permit. I have read in the NRA brochure on the gun laws of Alabama and it only mentions that you have to be 18 or older to have a handgun. In the Federal brochure on child gun laws it also defines a minor as one under 18 and cannot possess a handgun but those being over eighteen can. I am 19 so am also real interested in a lawyerly answer to this question, although my dad has no problems buying handguns for me as long as they are, uh, his. I wouldn't take this completely as fact but according to what I have read I am right.

I'm just trying to confirm that the face-to-face transfer of a handgun to someone who is 18 is legal. I've been told it is, but haven't heard any laws mentioned or been able to find anything on the internet relating to it.
 
its a gay law that has been put there by the democrats.

i am 20 and i have had a carry permit for over a year and have carried for over a year. you have to either have you parents buy it from a dealer and then sell it to you or give to you. you may be able to get away with also purchasing it from a person but it better not be a straw purchase, they buy it and turn around and sell it to you.

you can carry depending on what your state laws are for the minimal required age to recieve a ccw for your state.


i live in Indiana.

i wish they would change the limit back to 18 or give me the ability to purchase one while i have my carry permit, hell i would even let them have it TEMPORARILY registered, with those records being destroyed at 21, so that i could buy and not go through my parents
 
N3, the reason this exists is because of an interaction of federal and state law.

Federal law, the Safe Streets Act of 1968, mandates that to purchase a handgun from a FFL one must be at least 21. State laws cover all areas not addressed by the SSA.
 
Ok, so as long as it's not a straw purchase, its OK to buy from an individual at age 18. Personally, I'd rather buy from a gun store than an individual, but I'll take what I can get.
 
Just tell your parents what you want as a birthday gift :D Its how I got one of my pistols (actually, graduation, but same concept). Other came in a private party transfer.

EDIT: I should mention that I turned 18 last Jan.
 
i talked to my ffl dealer today and he said the ONLY way you can receive a handgun under 21 is from police force, military, parents. they said even the private party transfers are commiting a felony by selling them to people under 21. im gonna look into this some more.
 
Ignition, where are you? And don't always trust the FFL, I had one ask me once why I didn't carry. It took me and the two other employees to get it throught that I am not permitted to carry until I was 21.

Here is my MI 'safety permit' (pistol registration). When I got this, It was made clear to me that the only way I could not get the pistol was to buy directly from an FFL, due to Federal laws. Having parents buy for me could be a straw purchase. This particular pistol is a present, but my other was a face to face transfer.

im from indiana and i found out that my ffl just told me that just to be safe because he wasnt exactly sure.

Maybe I'll transfer to Purdue :D

I just sttuck that up there to show it was legal to own a pistol at 18. There was a guy I was just discussing this with (methinks at THR, but not sure) that was set that you HAD to be 21.
