The Range Conservation bill as been introduced by Rep. Neil Randall and in
seeking to get this enacted we hope to stop firing ranges from being dragged
into various forums to comply with environmental issues for matters that are
just plain harassment to attempt to close the ranges. The bill is in strike
all format and although I have provided a copy in this E-mail, it is best
read by reading it from the attachment I have provided.

I urge you to call Rep. Phil Angell (R) Randolph, who is the chairman of the
committee to which this bill has been assigned. Ask him to schedule hearings
on this bill which is so critical to keeping our ranges open.

Subject: Conservation; Act 250; shooting ranges; nuisance exemption
Statement of purpose: This bill proposes to exempt owners, operators, and
users of shooting ranges from civil and criminal liability relating to noise
when the range is used in a lawful manner. The bill also exempts shooting
ranges from Act 250.
AN ACT RELATING TO SHOOTING RANGES
It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. 10 V.S.A. § 5227 is amended to read:
§ 5227. SHOOTING RANGES; NUISANCE SUITS
The owner or operator of a shooting range and a person lawfully using the
range shall not be subject to civil liability for damages or criminal
responsibility resulting from noise or noise pollution under *[a]* the common
law theory of nuisance*[, provided that the range is in existence on or
before July 1, 1991 and has not expanded subsequent to that date. As used in
this section, a shooting range shall be considered to have expanded if it
increases in size, changes its activities or operation so as to substantially
increase the level of noise, or substantially increases its hours of
operation. A change which is intended solely to improve safety or solely to
decrease noise shall not be considered an expansion]*.

Sec. 2. 10 V.S.A. § 6081(o) is added to read:
(o) No permit is required under subsection (a) of this section for the
construction, operation, or expansion of a shooting range.
