Just read where various states and cities will initiate an investigation into the undue pressure being brought to bear on S&W because of its "deal" with the FEDS. Seems they are concerned because S&W master distributors are leaving.

That is life in the world of business to business marketing. No court will allow one manufacturer to dictate commercial terms of business for another manufacturer. In other words, the gov't forgot Business Law 101. This "agreement" will not stand up in court and the FEDS know it. When S&W begins to reap the consequences of its decisions the FEDS had to act by harassing other manufacturers and distributors.

The only question I have is when the counter suits will start.

We should protest louder and longer than the liberals.

Clinton should have been kicked out of office over seven years ago. Then, we would have had to do the same to Gore.

Conn. Subpoenas Firms in Gun Antitrust Probe

The state of Connecticut, suspecting collusion by the firearms industry to punish gunmaker Smith & Wesson for its promise to
improve handgun safety, yesterday subpoenaed records of other companies in the weapons trade.

New York's attorney general said he would follow suit within days as part of a coordinated strategy to bolster Smith & Wesson against a backlash prompted by the company's
unprecedented decision to supply gun locks and restrict gun sales.

"We knew and anticipated there would be criticism, some of it quite vehement. We didn't anticipate there would be apparently concerted activity to retaliate," Connecticut Attorney General
Richard Blumenthal said. "We have issued subpoenas. We are conducting interviews."

Blumenthal would not name the targets of the civil antitrust investigation or identify the recipients of subpoenas, except to say they are "companies in the industry." His New York
counterpart, Eliot Spitzer, said only, "We are intrigued by some of the things we have heard."

Maryland Attorney General J. Joseph Curran Jr. defined the theme of the investigation this way: "If a company is doing the right thing, don't block them. If you do, we're going to take you
to task."

Executives of rival gun companies dismissed yesterday's action as unwarranted, at best.

"It's just another effort to put more burdens on us," said Glock Inc. general counsel Paul Jannuzzo. As for a conspiracy among gunmakers to punish Smith & Wesson, he added: "It
doesn't exist."

In a settlement of numerous lawsuits, Smith & Wesson pledged March 17 to provide trigger-locking devices within 60 days and "smart gun" technology within three years on any new gun
it develops. The company also said it would supply products only to dealers who demand background checks and proof that customers have received firearms safety training.

Reaction to the agreement was swift and angry. The Gun Owners of America, for example, called it a "sellout." Smith & Wesson, the nation's largest gunmaker, soon began registering
examples of the firearms industry trying to hurt its business, said company spokesman Ken Jorgensen.

Gun magazines have quoted advertisers as pledging to pull their ads if the magazines continue to accept advertising from Smith & Wesson. Organizations that sponsor competitive
shooting matches have said they will pull out if Smith & Wesson is permitted to sponsor the events.

Jorgensen said Smith & Wesson met yesterday with some of its major distributors and dealers.

RSR Management Corp., a Winter Park, Fla., wholesaler and one of the largest distributors of Smith & Wesson weapons, has not decided whether to sign a new contract with the
company, a spokesman said. RSR will fulfill its contract to distribute the company's firearms through Dec. 31.

Other gun companies blasted the threat of antitrust litigation as a tactic to force them to match Smith & Wesson's concessions.

"What they're alleging is hogwash," said Jeff Reh, a spokesman for Beretta U.S.A. Corp. "The gun industry hasn't done anything."

To investigators, a central challenge will be the search for collusion.

"If there's a private agreement among competitors of Smith & Wesson to take action that would injure the ability of Smith & Wesson to market its weapons competitively – such as by
pulling advertisements in magazines that advertise Smith & Wesson – they could be very much subject to antitrust challenge," said James F. Rill, head of the Justice Department's antitrust
division during the Bush administration.

Officials at Beretta and elsewhere point to anger at Smith & Wesson that is not orchestrated. Individual customers and gun dealers, these officials report, have sworn never to buy another
Smith & Wesson gun because of what they call the company's capitulation to the anti-gun sentiments of the Clinton administration.

"There's a strong consumer backlash," said Robert Delfay, head of the National Shooting Sports Foundation, the largest firearms trade group. "That's not the industry and it's not antitrust."

To pressure the other gunmakers, the Clinton administration announced last week that 28 cities and counties will give preferences to firearms manufacturers that produce safer guns and
endorse a code of conduct. The goal, said Spitzer, is to "squeeze manufacturers like a pincers."

"We want to stand with Smith & Wesson," Los Angeles City Attorney Jim Hahn said yesterday, noting that the city council there is considering a preference rule. "We want to deal with
responsible manufacturers."

Call the SOB's office, and let them know you're now a firm supporter of any Smith & Wesson boycott. These b*****ds want a fight - tell them they'll have one.
 
Let's see, suppose I was a distributor/wholesaler dealing in, say, auto parts. Now, Manufacturer A (an important manufacturer, but far from the only one) says:
1) I have to change how I do business with all the other manufacturers if I wish to continue to do business with them
2) If I don't live up to the contract they - not I - signed, they will drop me

Might I get just a little ticked off?

Add in the fact that I know that a lot of my customers are angry at Manufacturer A, and therefore sales of their products are going to decline, and I don't want my customers or other suppliers to find another distributor - one that will do business on their terms...

What choice would I have but to drop Manufacturer A?

The only conspiracy I see is one manufacturer trying use it's distributors to force it's contract on all the other manufacturers.

When it comes down to it, it's you and I that decide what we buy. If we all decide not to buy S&W, the distributors won't carry them. But we need to be sure that money we would have spent on S&W products goes where it should (e.g. Ruger, Glock, etc., etc.).

Thought I'd reply to my own message.

What's missing here is an example of how the media plays this "agreement." The original announcement gets great fanfare in the dominant press. Then the Second Amendment supporters respond in their own piddling way, they simple take their money and go away. This counter action is quite predictable, yet seems to be beyond the comprehension of our ink stained scribes. The counter action is evidently taking effect so the gov't counters our counter action: they look into anti-trust violations (which is widely reported).

So what does the average mind-numbed, Second Amendment ignorant citizen see? Why, they see gov't taking a big swing at the "gun lobby" followed by a jab implying the gun nuts are doing something illegal. After all, these guns oughta be illegal, right?

The media blackout will continue until someone is successful in pulling a Lapierre. I predict all sides will lose interest in the "agreement" just as soon as some grows some ****'s and gets this case into civil court where it can be aired. Then you will hear about threats, intimidation, posturing, etc. In short you will hear how a fascist government conducts business.

By the way, with the S&W "agreement," did the FEDS effectively nationalize a gun manufacturer??????

Here's my letter to NY AG Spitzer:

Attorney General Spitzer,

"Our goal is simple, we want every appropriate government entity to agree
to purchase firearms only from companies that have signed a comprehensive code
of conduct."

After reviewing your statement I am incredulous as to how the Attorney General for the State of New York can openly countenance behavior that best falls under the RICO statutes in spirit, or at least conspiracy to commit such were it done by any other group or entity.

The 'voluntary, legal' extorsion agreed to by Smith&Wesson apparently emboldens those who consider the rule of law and constitutionality a mere inconvenience when they can do through threats of bankruptcy, and fiat what they are unable to do legislatively. As servants, is this not precisely what the government should be protecting the people from rather than engaging in itself?

Now that firearms distributors, retailers and owners have taken up the challenge and begun to boycott S&W for their acquiescence in this legal sham,
Attorneys' General are considering legal sanctions against boycotters for 'conspiratorial activity' . This is truly Orwellian, but not surprising as the gap differentiating between the actions of organized crime and the actions of the goverment narrows daily.

I will certainly do what I can via the elective process to help remove you from office.

Mr. Blumenthal -
Your search for evidence of collusion by the firearms industry to punish Smith & Wessen
is misguided. It is "we, the people" who wish to punish Smith & Wessen by boycott
and any other legal means necessary. Such activity is our right under the Constitution and
has been undertaken to defend the second amendment to that document.
It seems to me that if any parties are guilty of collusion it is the Clinton Administration and
Thompkins, PLC in their attempt to subvert the American legislative process and further
restrict the constitutional rights of U.S. citizens.
