Gore and Surpreme Court Justices

I read a post here regarding Gore and Bushes positions on gun control. One thing I haven't heard much about is great potential for Gore (if elected)could appoint as many as four surpreme court justices (a majority).
Do you think the surpreme court could redefine the 2nd amendment or clarify it to "their" definition?
To me this is the scariest and perhaps the most likely scenario for the anti-gunners to make giant strides in partially or completely disarming the US. I haven't seen this arguement used before, and was wondering if it's valid.

It is real valid and possible, Thats one of the reasons not to vote Gore ;)

Most of the problems that are attributed to the Supreme Court really have to do with lower court decisions that have the force of law. (The one big exception, of course, was Roe v. Wade.) It is the lower court appointments that tend to have the biggest effect on government and law, not The Supremes...

In recent years, the SC Justices have NOT ruled on gun control issues, and at least one Justice (Thomas) has spoken out sharply in support of the 2nd Amendment right to keep and bear arms.

Interestingly enough, Laurence Tribe, a strong liberal, and considered one of the most influential scholars/experts on the Constitution, has come in recent years to be very sympathetic to the indivdiual right(as opposed to collective right) interpretation of the 2nd Amendment.

This has caused much consternation among the anti-gun nuts. He's even had death threats.

Any new president has the potential to shape and change the nature of government through Federal Court nominations -- and this election is no different than any other. But watch the lower court decisions -- they tend to have more impact!

This is the main reason that I will vote for Bush this November 7. The rest of my ballot will probably be Libertarian as much as possible. Except for my local Representative to the State Legislature. Republican Bryan Williams supported and was a co-sponsor of more than one CCW bill in the Ohio House this past session.

Bush needs to win so that Gore won't. His appointments to the SC bench will undoubtedly be better than what algore's would be.

The Senate has a critical role in this process, as well--so let's hope it stays GOP. A Rehnquist-Scalia-Bork-Thomas conservative block would have changed the face of constitutional law. Imagine if all those dissents had been majority opinions. I'm afraid that chance won't come again in our lifetimes. I *know* it won't if Gore gets in and the Demos take charge of Congress again.

LMikeW,

AlGore has made it very clear that he considers the Constitution to be a "living and breathing" document. This should terrify anyone and everyone who believes in the principles our nation were founded upon.

What "living and breathing" means is that the Constitution would mean anything that the Supreme Court says it does. Precedent and original intent would mean nothing! Already, the Clinton/Gore Justice Department has argued in the Emerson case that the Second Amendment only recognizes the right of the National Guard to be armed. And only while on duty! According to the Clinton/Gore Justice Department, individual citizens have absolutely NO Constitutional right to own or possess arms.

If the Emerson case gets to a Supreme Court dominated by AlGore justices who follow his belief of a "living and breathing" Constitution, you can kiss the Second Amendment goodbye. The ability to own a gun will then become a government granted priviledge, given only to those that the government deems worthy, or as AlGore likes to put it "the right people"!

Will you be one of "the right people"?

A Gore SC would launch an all out attack on the Bill of Rights. Second Amendment is gone quicker than a new york minute. Freedom of Religion will be curtailed because of hate crime laws. Freedom of Speech suffers the same fate. Due process found in the Fourth Amendment--out the window. Judges are just too inconvenient when federales need search warrants.

Under Gore the assault on the BofR will go public even though it is a raging battle now. Forget help from Big Media; they are part of the enemy.
