Good shoot/ Bad shoot

Hypothetical:

I'm at my home with my wife having dinner. We decide (as adults) to have a few cocktails. They go down pretty good, so we have a few more and go to bed legally drunk. A short time later, back door gets kicked in, dog goes nuts, I grab my 12ga and discover a BG (in the house) with bad intentions.....you know the rest.

When the LEO's show up, i'm still legally drunk from the nights festivities.
Good shoot?
 
I would say so. As long as he broke into your house, was indeed a threat, and you stopped the threat, it was a good shoot. No law says you cannot sleep off a drunk in your own bed. Plenty of laws state that he cannot break into your house while you are sleeping off that drunk.

It gets iffy when the BG turns out to be not such a BG, say, your BiL or the Bug Man. If the Etoh impairs your judgement, you may make a costly mistake in that area.
 
You'd be guilty of a misedmeanor of possession of a gun while intoxicated, or something like that, but the shooting would be OK, and I doubt you'd be prosecuted because it would mean the police taking you in to have blood drawn and they'd have other things on their mind most likely. You best have pretty good liability insurance though if you're shooting people while drunk.
 
I imagine the civil suit would be ugly for sure. This scenario did cross my mind once or twice. I only drink at home, and thats rarely...well, i might have a beer with the fellas at the VFW...but that's it. Just wondering what the legalities would be. I'm not talkin' falling down, drooling drunk here, I never get like that, but i do like a good bottle of wine, a cold beer, or a frosty margarita :p . Hard to find info on this topic.
 
Was he a threat? (Yes, he was in your house.) Did you kill him? (Yes.)

Then yes, it would be a good shoot. :)
 
Well too bad you dont live in Ok. We have the make my day law saying if someone breaks in you have the right to fire and if it happens that you killed the BG you wont be charged for anything.Good shoot
 
I would have me a Mixed drink in my hand, and/or a couple of shot glasses on the table in another room with a bottle of booze handy.

"Sir, have you been drinking all night?"

"Not a drop until I had to shoot this dirtbag, and had a shot or two to calm my nerves"

The cop is happy, and you are covered from questions like..." If you weren't drunk, are you sure that you wouldn't have shot him?"

I believe that the police would "do their duty" and report tht you were impaired and you would be answering a subpoena in a wrongful death lawsuit.

Honesty is not always the best policy...especially in life or death situations. :(
