Subject: VA-ALERT: *** YES!!!! Restaurant Ban out of Committee!!***

>It was an outstanding day in the Militia and Police committee today
>for gun owners and freedom lovers in general. All of the anti-gun
>bills died horrible, humiliating, bipartisan, deaths - trigger locks,
>Fairfax Gun Ban, ballistic fingerprinting, a ban on all guns in
>schools, you name it, it died!
>
>Meanwhile several pro-gun bills made it out of committee and one has
>been temporarily set aside.
>
>Thanks to your help, Lee Ware modified his restaurant ban repeal,
>taking out most of the bad language. The new bill does **not** ban
>consumption nor carry in dance halls or exotic dancing
>establishments. It does allow for a judge to rule a place a
>"nuisance" and then they **must** post signs at all entrances banning
>concealed carry. The bill passed out of committee with a large
>bipartisan majority!
>
>The bill is not perfect, and VCDL will be studying it carefully to
>decide on the best way to improve it. But this is a great starting
>point and for the first time we have got the restaurant ban repeal
>out of committee. We have a long way yet to go (House Floor,Senate
>Sub-committee, Senate Committee, Senate Floor, possible conference
>committee, and then the Governor) and we must all keep the pressure
>on the whole way. WE CANNOT LET UP FOR A MINUTE. However, the train
>has left the station and it seems to be moving our way!!
>
>BTW, you should have heard the Virginia Restaurant Association
>howling after the hearing! As usual they were telling the press
>about all the blood in the streets that would surely follow passage
>of this bill. However, the press was getting information from both
>sides. Hopefully they will give us a fair shake. We'll see...
>
>There were approximately 50 people representing gun owners and a
>handful from the other side. It was impressive when the committee
>asked the anti's to stand to support/not support a bill (5 people
>stand up), then they asked US to stand. A rumbling sound ensued as
>50 people from all walks of life stood in unison - men, women, young,
>old, black, white. The anti's were simply and completely
>overwhelmed. That is the kind of support it takes to get the job
>done. Thanks to all who took off their Saturday to stand and be
>heard. I am proud to be among you.
>
>**** Let's thank Delegate Ware for vastly improving his
>restaurant-ban repeal bill and for fighting for gun owners. Let
>there be no mistake, there were many who wanted him to drop this
>bill, but he did not. ****
>
>Delegate Abbitt's reciprocity bill was left on the table (it is not
>dead, but it is on life-support). Delegate McClure's omnibus gun
>bill was passed out of committee instead. Delegate McClure's bill
>contains a lot of provision to cleanup various problems with
>Virginia's gun laws. McClure's bill also has reciprocity language.
>At best the reciprocity language does not improve what Virginia has
>now and at worst it could make reciprocity even harder to establish
>as it appears to give the State Police too much discretion. Delegate
>Abbitt's bill is much better and VCDL will be pushing to revive
>Delegate Abbitt's bill.
>
>*** We should thank Delegate Abbitt for his unwavering support for
>gun owners with his reciprocity bill. He is nothing if not
>tenacious. We should also ask him to try and get his bill on to the
>floor. ***
>
>Finally, Delegate McClure's preemption bill also passed out of
>committee with one minor, insignificant change by the State Police.
>Alexandria tried desperately to put in language that would have
>destroyed the bill, but the committee refused to accept Alexandria's
>changes. The bill was passed out of committee in a form that VCDL
>supports and if passed in this form will greatly help get rid of
>local gun bans, such as the one in Alexandria's city buildings.
>
>*** We should thank Delegate McClure for his preemption bill. ***
>
>Finally, all pro-gun members of the committee should be thanked for
>their support of gun owners in the Commonwealth.
>
>Our work has really just begun and it may be a month before we know
>the final result, but today was a good day. Let's bask in the glow
>for a few minutes and get back into the fight.

Full Restaurant Ban Repeal and Real Concealed-carry Recognition Will
Be Before Full House Any Day Now!

Gun Owners of America E-Mail/FAX Alert

February 3, 2001

Dear Virginia Gun Rights Supporter,

I have some good new and some bad news to report to you from this
morning's House Militia and Police Committee meeting.

First, the bad news.

The Militia and Police Committee killed H.B. 1655, the real
Concealed-carry Recognition bill, and passed H.B. 2130 by anti-gun
ringleader Delegate McClure. H.B. 2130 contains so-called
"reciprocity" that actually makes it harder to get other states to
recognize Virginia's concealed carry permits by leaving all
decisions to unelected, anti-gun bureaucrats.

And the committee passed H.B. 2658, without language fully repealing
the Restaurant Ban.

The good news is that your action has made a difference. Because of
your calls and e-mails, the committee cleaned up a patchwork of
"safety free zones" in H.B. 2658-- but they haven't gone all the way
in fully repealing the Restaurant Ban.

In fact, the committee amended section J1 to force you to waive your
Fourth Amendment rights and submit to arbitrary requests for blood
and breath samples without probable cause. Section J1 should be
amended back to its original language.

H.B. 2130 and H.B. 2658 will be on the House floor sometime before
the constitutional deadline of Tuesday night, but they could be
voted on as soon as Sunday.

Now more than ever you and I must sound the alarm to gun owners
across Virginia to turn up the heat on the politicians.

Call or e-mail your Delegate immediately and tell him or her to
support full Restaurant Ban Repeal and real Concealed-carry
Recognition at every opportunity.

Specifically, tell your Delegate to:

1. Support an amendment to H.B. 2130 and H.B. 2658 to restore full
Restaurant Ban Repeal by completely striking section J3 from
18.2-308 of the Code of Virginia and completely restoring section J1
to its original language.

By restoring J1 to its original language, honest, law-abiding gun
owners won't have to waive their Fourth Amendment rights to carry
concealed in a restaurant.

Tell your Delegate to make a motion, second another Delegate's
motion and vote in favor of an amendment to fully repeal the
restaurant ban.

And tell your Delegate anything less than full Restaurant Ban Repeal
is completely unacceptable.

2. Support an amendment to H.B. 2130 and H.B. 2658 to add real
Concealed-carry language to these bills.

Tell your Delegate to make a motion, second another Delegate's
motion and vote in favor of an amendment to add real Concealed-carry
Recognition to H.B. 2130 and H.B. 2658.

And tell your Delegate anything less than real Concealed-carry
Recognition is completely unacceptable.

Gun Owners of America supports the full Restaurant Ban Repeal, which
would restore the right of self-defense for law abiding citizens in
most Virginia restaurants and as people go to and from their car in
the parking lot. Criminals should not be allowed this "safety-free
zone" to commit their offenses against citizens who have been
disarmed by current law.

And Gun Owners of America supports real Concealed-carry recognition,
which would allow Virginia concealed-carry permit holders to protect
themselves in many states that also have a concealed carry law. For
example, once Virginia recognizes Florida's permit, then Florida
automatically recognizes Virginia's.

Tell your Delegate to support full Restaurant Ban Repeal and real
Concealed-carry Recognition at every opportunity and that gun owners
want a recorded, roll-call vote so we'll know where members of the
House stand on these critical issues.

You must call or e-mail you delegate at once. H.B. 2130 and
H.B. 2658 could be on the House floor as early as Sunday.

You and I can force the politicians to take a stand on full
Restaurant Ban Repeal and real Concealed-carry Recognition if we act
today.

Please don't delay. Your right to self-defense hangs in the
balance. Call or e-mail your Delegate at once.

Sincerely,

Dennis Fusaro
Director of State Legislation

***** Pre-written message *****

Dear Delegate,

Support full Restaurant Ban Repeal and real Concealed-carry
Recognition at every opportunity.

Please make a motion, second another Delegate's motion and vote in
favor of an amendment to H.B. 2130 and H.B. 2658, which restores the
full Restaurant Ban Repeal by completely striking Section J3 from
18.2-308 of the Code of Virginia.

And please restore Section J1 to its original language so honest,
law-abiding gun owners won't have to waive their Fourth Amendment
rights and be subject to arbitrary blood and breath samples in order
to defend themselves while eating a meal or going to and from their
car at their favorite steak house or pizzeria.

Anything less than full Restaurant Ban Repeal is completely
unacceptable.

Second, please make a motion, second another Delegate's motion and
vote in favor of an amendment to H.B. 2130 and H.B. 2658 that adds
real Concealed-carry language to these bills. Anything less than
real Concealed-carry Recognition is completely unacceptable.

Sincerely,
