Garand : NY legal?

Quick question for you NY'ers out there. I've been thinking of scratching my brother's itch for his own Garand. He is 18 this year and lives on Long Island. I live in IL, and would really love to surprise him for his first summer home from college.

Any particular hoops or hassles involved aside from the usual FFL stuff? I realize that he manages to live in a state that's actually worse than mine :)

edit : One option I'd like to explore is the "surprise" option. My dad lives in NY and I'm thinking I could transfer the firearm to him, and have him gift it to my brother. However, I'm aware of the whole "strawman" issue and would like to avoid making any mistakes. Advice welcome.

Not a resident

I grew up in northern NY state, but I am no longer a resident. Someone else will have to fill you in on the current laws (and be aware that localities often have their own in addition to the state regulations. NYC has different laws than the state in general.

That said, the M1 Garand "should" be treated no different than other semi auto "sporting" rifles (like Remingtons). It holds less than 10 rounds, it does NOT have a detachable magazine, it does not have a "conspicuously protruding pistol grip", it does not have a flash suppressor, the only "evil" feature it has in common with those "Nasty" semi-automatic assault rifles, is that it does have a bayonet lug.

As far as the "straw man" purchase, the law still allows you to purchase a firearm, "as a gift". Best bet is to follow what the gunshop recommends.

If there have been no changes to the state law since I lived there (it was quite a while ago), and if there are no local ordinances requiring registration (NYC has them for rifles), there is no reason your Dad could not just puit a bow on it and hand it to your brother.

But check first, my info is rather dated.

Garands are legal everywhere in NY. Even here in NYC because the city council was afraid to piss off all the veterans(ie. seniors who vote) living there. The prices for Garands here are totally outrageous though. My advice would be to buy where you are and transfer it to an ffl in Long Island to sign over directly to your brother. There's a $35 fee for ffl transfers but you want to make sure everything is legal so your brother avoids being hassled by the local leo's who are sniffing around for straw purchasers.

Yes, Garands are the rifle of choice for the NY resident. Thanks to the internal magazine they nicely fall through the cracks of our BS AWB.

Unless you are taking it to NYC though you do NOT need to worry about an FFL transfer. Rifles are NOT registerred outside of New York City. In fact there is no way you could register it outside of New York City as there is no system in place. That means no records of transfer or ownership. At least that is still intact in NY...
