FS 790.15...Opinion on this?

Not that I would, couldn't do it safely...

But my wife's co-worker insisted to her that it is perfectly legal to set up a target range on private property provided it is not done recklessly, and forwarded a you-tube vid of some guy doing this in the Keys...

Anyone familiar with this statute, and whether it's been "tested"?

State law would seem to trump all local ordinances in this area. Any FL attorneys here that can comment on this?

790.15 Discharging firearm in public.--

(1) Except as provided in subsection (2) or subsection (3), any person who knowingly discharges a firearm in any public place or on the right-of-way of any paved public road, highway, or street or whosoever knowingly discharges any firearm over the right-of-way of any paved public road, highway, or street or over any occupied premises is guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. This section does not apply to a person lawfully defending life or property or performing official duties requiring the discharge of a firearm or to a person discharging a firearm on public roads or properties expressly approved for hunting by the Fish and Wildlife Conservation Commission or Division of Forestry.

Not an attorney, but this has been discussed by our gun group here in Florida and commented on by many attorneys, some of whom regularly write or help write Florida gun law.

The interpretation given to me is that it is 100% legal as long as bullets don't leave your property and you don't shoot over a road, body of water, residence, etc.

Have a good and proper berm if you're going to do so. A very high one.
