For those who think the battle is over

Stay Tuned:
Turns out our rather pretty Secretary of State, Katherine Harris runs the department that houses the Florida State Election Canvassing Board. Seems that Board is responsible for certifying the individual County votes. It also appears that the State Board has rather wide ranging powers to certify a vote, not certify it or even certify one of multiple counts in any County. Did I mention that Katherine is a Republican?...only fair, I think. It adds "balance" to the 3 Democrats on Palm Beach that are currently running the telepathic recount. :D

OTOH, Gore's making noises that he'll concede after the Electoral College votes! Do I hear "protracted Court Battle".

From the Constitution of The United States of America, Amendment XX, Section 3:

quote:
If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.[/quote]

Let's summarize the hurdles in Gore's path:

1. He needs to win the hearing tomorrow and prevent an injunction against manual recounts
2. He needs to win the extension of the 5PM Tuesday deadline
3. He needs to convince a judge that cherrypicked counties still afford all citizens equal protection under the law - if not the whole state (nation?) will be recounted
4. He must hope the Certification Commission does not just go ahead and use the first recount numbers since the manual numbers will be too confusing. Also, he must hope the SecState agrees that voter error is a reason for a manual recount
5. He must hope that the FL legislature doesn't just go ahead and appoint the GOP slate of electors
6. He must hope the GOP-controlled House accepts the numbers if he wins

Sounds like long odds to me...

Posted by Tim Burke on another thread...

Just saw on ABC news that the Florida SecState has announced that the Tuesday deadline WILL be enforced. The network also stated that the hand recount will NOT be completed by Tuesday, and noted that it took the Palm Beach Co. Election board 9 hours yesterday to hand recount 1% of the vote. 9 hours x 100 / 24 = 37.5 days to do the full hand recount. (My math.)

Yeah, there's a lawsuit to extend the deadline, but judges usually know to stay out of elections unless there is widespread evidence of fraud. So far, there is no evidence of Republican fraud, only widespread Democratic stupidity.

Yes Rich, we are far from being defeated!

So what count will be determined to use as the final vote?

Does anybody have a link to an official Florida Elections site that actually has the laws regarding recount? NOT MEDIA SOURCES!

walangkatapat,

Once there, click on "Division of Elections", then click on "Laws and Procedures".

Hope this is what you are looking for...

God so values free will that He gave us all the freedom to turn our back on even Him. If liberty is that important to God, it should be that important to us all...

Been there, done that, didn't find it. It should be there somewhere, but I was unable to find it. Can you?

Once you get to the "Laws and Procedures" page, try selecting:

"Chapter 101 Voting Methods and Procedure"

and then

"101.5615 Recounts and election contests."

I didn't read too far, but that may be what you are looking for.

Ken

That has to do with equipment tests. You'd think it would be easy to find such a topic under these circumstances, but I've yet to find it.

Thanks ... I'm feeling a bit better. My greatest concern in this situation is that Republicans are too used to doing the sober, 'decent' thing .... but, we're dealing with a ruthless enemy. Sneaky bastar*s.

folkbabe raises an interesting question on a related thread ... how does this certification deadline affect the overseas ballots, or vice versa?

Regards from AZ

walangkatapat,

Try this, it has some language directly addressing recounting of votes. It doesn't offer much insight into the process though.

102.141 County canvassing board; duties
Paragraph (4)

<edit> Found this too:
102.166 Protest of election returns; procedure.

Jeff,

The deadline has NO affect on the absentee ballots. They have until the 17th of November at 5:00pm to arrive. At that time they will be counted.

You're not getting the picture, are you?

The Republicans have entered the ring, wearing regulation boxing gloves, and have taken a classic fighter's stance. The Dems have run in under the ropes and kicked the Repubs in the testicles with a steel-toed boot.

The Repubs, and people on this group, have so far been clueless. You don't defeat a street fighter with boxing gloves. The Dems have perfected the political mugging and are doing it again. On December 18, if nothing stops the Dems, the Electors from the states certified at that point will give Gore the presidency.

It sickens me to see the Dems winning more PR every day on TV. Repubs are either unwilling or unable to fight back. We see Gore, smiling, with family, busily surrounded by flags and big offices and happy crowds. Then, we see Bush, with his face bandaged, standing in his driveway, looking dazed, like he just realized he locked himself out of his house. So far, he has done zero to look presidential. Meanwhile, Baker whines on TV about this terrible Democrats.

Who do YOU think is going to win this?

And oh, by the way, you 32,000,000 gun owners who voted for Gore or stayed home ... thanks!

What mystifies and angers me is that the Dems seem to be getting preferential recounts by hand in Democrat-favored counties, therefore boosting Democrat votes, while Republican-favored counties are not being hand counted. So, Gore's votes can only increase. I mean, this sounds like what's happening in Florida. Am I wrong? For hand recounts to be done anywhere, shouldn't they be done everywhere, in this close a race?

Woodit-
You're the one that doesn't get it. The only thing worse than whining after you've lost is whining before you've lost. Is that what you're doing? ;)

I swear, with all the belly achin' I'm seeing, I don't think there's a half dozen people outside the Staff Lounge that I'd invite to hold my coat in a street fight!

How, 'bout we make it more constructive? Like earning money on your position? I say George Bush will be our next President. I've got $1,000 that says so and all you have to risk is $600 to take it from me. Now put up or...whatever. Only requirement is that you email me and we exchange snail addys. Then we can both post back here that we've put our money where our mouths are. After all, what's a few bucks when the nation is in it's Death Throes? Money won't help in the NWO anyway.

Ball's in your court. Anyone else?
Rich

We can win this thing folks. Miami-Dade and Broward are not going to recount. People are starting to get frustrated with this--they want a resolution. By this weekend, the tension will be peaking. They have certified the ballots statewide less the absentee ballots which will be counted on Saturday. Secretary Harris has requested a reason for late returns from Palm Beach County. It would be reasonable for her to not accept these votes given no hand counts in other counties, but she is going to take a beating for this politically. Please e-mail Ms. Harris and support our position that there should be no recounts in Palm Beach County. Could someone post a link for her e-mail address. I e-mailed her yesterday. Take one minute and compose a supportive, positive letter. Don't give up--we can WIN!
