folding stock on sks in california?

i would like to know if i can legally put a folding stock or other type of "evil" stock on my sks, even though i live in california. thanks to all.

Unless it was grandfathered and registered, you may not create a new "Assault rifle" and the SKS is specifically named. Any modifications that make it more evil are illegal. This prevents terrorists from operating in Californica.


Don't ask me how. I'm not a frothing liberal bent on controlling every aspect of a person's life to keep them "free."
 
Theres not even such thing as a grand fathered one. It would be more of a federal offense. The Assault weapons ban had nothing to do with an SKS. It does apply to the SKS when there is a detachable mag and 2 or more features but the folding stock is still illegal because a folding stock SKS would be non importable and creating one using more than 10 imported parts is illegal. Then even if the weapon was imported before the 1989 import ban and set in a warehouse till 1990 it can't have a folder on it. There was no grandfather clause that I am aware of in the 1989 import ban.

Just keep the fixed mag.

Here is my understanding. First, forget about federal law. You will break the state law (SB 23) before you break the federal law. My understanding is that you cannot have an "assault rifle" without a detachable magazine. As long as you keep the standard fixed magazine, you are not going to break the law. Should you put a detachable magazine on your SKS, then you are restricted in the following ways.

You may not have:

1) a bayonet.
2) a pistol grip stock.
3) a folding stock.
4) a thumbhole stock.
5) a flash suppressor.


And there might be a few more no-nos, but those are the main ones that apply to the SKS.

I bought a fixed folding pistol grip stock for mine a few years back. I didn't like it because the stock had about an 1/8" movement where it was fixed and the pistol grip and the trigger guard didn't match up the way I liked. Also the bayonet came out away from the stock so if my hand were to slide forward, I would basically wedge my hand between the bayonet and the stock! When I sold one of my SKS's to a friend, I added the stock in with it and just put the original wood back on my Russian SKS.

I would ask yourself, what are the benefits of replacing your wood stock? I tried it and found that it was best to just leave it as is. 2nd benefit, there is no mistaking the law because it is in its orginal condition. Whatever you decide, good luck.
 
NO NO NO NO and NO, You have to modify the weapon and according to the ATF letter to the NRA you have to have the Monte Carlo stock and take off the bayonet lug to use a detach, if you have any of those other things on the weapon then you have modified so it would not be nonimportable. Plus your folding stock thoery is flawed on any rifle.I have never seen an SKS folder that did not have a pistol grip. Folder+Pistol=2 evil features.
 
Am I wrong? Must the rifle have a detachable magazine in order to be considered an assault weapon? Under PRK law, you only need to have one of the assault features! I think many of you are answering this question based on the 1994 Assault Weapons ban. I wish that was the case here! I would have an AR right now. We are under much more restrict rules. However, all of these rules exclude fixed magazined rifles. Please someone tell me if I am making an arse of myself.
 
I thought you were refering to the federal law. Still for those who wonder even out side of California folders are illegal on SKS, they even use it as an example in the federal regs book.
 
My understanding for all of the laws were that they only applied to centerfire rifles with a detachable magazine. The SKS does not have a detachable magazine in its orginal configuration. Could someone help us out here? I will look, later. Now I have to go finish trimming the tree (not the bush).
 
El Rojo ... In CA the feature list your refer to is for Centerfire semi-auto with detach mags. The third category, IIRC, is centerfire rifles with fixed mags over 10 rounds ... the little SKS, as manufactured, skirts these laws like it was designed for us! It is, however, mentioned specifically as an assault weapon regardless of the absence of features, if you go to a detachable mag ...
SKS + detachable mag = AW = No-No

That's my understanding ...

However, on the bright side: the '51 Tula's will be California C&R in a couple of months! Feliz Año Nuevo! :D
