Florida residents cannot buy firearms in New York, by law?!

Okay, this was a shocker for me yesterday:

I went with my dad to Walmart in Islandia, Long Island. Not there to buy a gun or anything, but I walked past the rifle and shotgun racks just to glance at them.

There was a sign placard inside the case with a map of the U.S., and a color-coded legend. There were mostly states filled out in green, and a handful of states (no more than 10, it seemed) that were red. Residents of the red states, the legend said, cannot purchase firearms (not "handguns," or "rifles," but "firearms") in New York -- and among those states was Florida! (I live in Florida.)

I never heard of this. What's the basis for it? I thought that anyone could buy a long gun in any state they didn't live in as long as they of course were buying for themselves, privately, and met all the typical legal requirements, and the state where the gun is purchased is not a state like IL or MA, which require a license even for long guns (unless I'm mistaken).

Whose law makes it illegal for me to buy a rifle or shotgun in NY if I am a FL resident?? :confused:

was there any fine print on that placard? perhaps a walmart regulation? i believe stores have rights not to sell firearms to anyone if they choose not to do so. they dont say you cant buy a long gun, but they can say "go but it somewhere else".

i dunno, sounds odd, i dont recall seeing any state law regulating sales of long guns to residents of other states....
 
I think I know why...

Fl is packed with too many people from NY.
And NY law makers are getting angry.

Sort of like a.... OKAY YOU MOVED TO FL NOW STAY THERE!. kind of tactic...

I think the different counties and municipalities near New Yawk City have a contest to see who can make the most restrictive firearms laws...
 
No no no....you have it all wrong. I know how NY works (55years as a resident).

NY is angry at folks who move to Florida and take their Pensions, Social Security and savings out of the state! Now the state can not get any of that money!

I have lived in PA for three years and they still send me "Demand for payment" notices for taxes I do not owe.
 
Are you talking about me, moved out of the Land of Taxes three years ago and the best thing I ever did.I can now own a revolver with out selling my soul :D
 
Whose law? President Johnson's law, the Safe Street Act of 1968 prohibits interstate sales of firearms (modified in 1986 to exempt long guns in adjacent states).

If you wish to purchase a weapon in New York state, simply have the FFL ship it to your FFL in Florida. :)

how could he get a ffl transfer if they wont sell him the firearm?? what you say makes most sense, but if they [walmart] wont even make the sale he cant get a transfer.
 
I heard about that "Adjacent State" thing, but I was led to understand that it was no longer in effect.

NY makes it's own Laws. NYC and some counties make even more restrictive laws.

Why buy in NY anyway. Go to PA and buy in a state that recognizes the constitution.Don't give sales tax money to the commies in Albany.

In NY, standard rifles and shotguns are NOT firearms. SHOULD be NO problem buying one., although I am sure the guys at Walmart wouldn't understand. Firearms are regulated - usually illegal to possess (along with other deadly weapons), or require a special permit (Concealed carry / Pistol Permit for pistols and revovlers)...

A person is guilty of criminal possession of a weapon in the fourth degree when:

(1) He possesses any firearm, electronic dart gun, electronic stun gun, gravity knife, switchblade knife, pilum ballistic knife, metal knuckle knife, cane sword, billy, blackjack, bludgeon, metal knuckles, chuka stick, sand bag, sandclub, wrist-brace type slingshot or slungshot, shirken or "Kung Fu star"; or ...
 
99% of the time you will get a better deal in another state anyway so don't bother buying here in NY. Besides, buy buying here you give money to NYS in the form of sales tax. If I could buy my guns easily in other states I would.

The bottom line with gun laws in NY is this...

They make up their own and see no reason why any federal laws or even the Constitution , should affect them.
 
It's Florida Law not NY

Florida probably still has a contiquous state law on it's books, even though it was repealed at the Federal level.

790.28 Purchase of rifles and shotguns in contiguous states.--A resident of this state may purchase a rifle or shotgun in any state contiguous to this state if he or she conforms to applicable laws and regulations of the United States, of the state where the purchase is made, and of this state.
