First, CC, Second, Castle Doctrine

Wisconsin's motto is: "FORWARD"! Well, it's about time. First we get concealed carry; a long, hard, up-hill fight, but we got it!

Now, both the Assembly and Senate have passed a Castle Doctrine bill. I do not know all the particulars yet, but the "defender" is now afforded both criminal and civil protections if he/she shoots an intruder. (I've heard it covering "home"... "business"... "automobile" so far)

There are exceptions for "being engaged in criminal activity" and "shooting a cop when you should have known he/she was a cop", and both the Assembly and Senate noted this (though the wording in the Senate is different so it's going back to the Assembly for a re-write).

This is a great move and something that was long overdue in Wisconsin. Under current law, we have a "duty to retreat" (even in your own home). Also, if we shoot an intruder and he turns out to be unarmed, we could be charged with a whole host of really nasty legal stuff for using "excessive force" ... and then get sued by the perp or his family in a civil action.

I'm disabled and I can only retreat if the perp is also in a wheelchair or in a walker ... otherwise I'd be "overrun"! Besides, just what the heck is somebody doing in my house since I have my doors and windows locked?

Gov. Walker said he would sign it ... so I hope to see this on the books in a matter of days because the Assembly just did this on Tuesday and it went to the Senate on Wednesday and passed today. Maybe next week???

Reciprocity?

Does Wisconsin have any reciprocity with other states yet? I live in Michigan and have a CPL/CCW here and really hate having to disarm before I reach the border. Is there a listing somewhere of states they have reciprocal agreements with?

sounds like it has a little political B.S. in it.... so, it was legal to shoot a cop before if you knew they were a cop?

but anyway... the best part about these is the stopping of a civil suit if you can't be charged criminally for defending yourself or someone else....

I don't think it was legal to shoot a cop ever. But if a cop kicks your door in without identifying themselves as law enforcement, u would guess this gives you some sort of protection from prosecution.

I think the idea was to prevent a certain class of lawyer from having a truly criminal client being found not guilty because the perp shot the cop in "self-defense". I know it's stupid ... but you do have to apparently spell EVERYTHING out because some jurors are incapable of logical thought.

PS ... Sheriff Clark (down Milwaukee way) was on the radio the other day talking about this bill and told the show host that he has a sign in his window with a picture of a (I forget what, but a BIG, NASTY DOG) and a pistol. The wording: "WE DON'T DIAL 9-1-1".

PPS ... Just heard that the Assembly matched it's wording to the Senate's version and repassed the legislation ... and now it's on Scott Walker's desk. It may well be signed before the day's out. OH, HAPPY DAY:D

wow they really did kill two birds with one stone(or they're waiting for the 2nd bird to die shortly).

This is a good thing in my book - laws like this are there to protect the innocent, law-abiding citizens in their home. Gun sales in WI must be going up...
