FFL transfer question, would this be illegal?

Long story short, I bought a gun over the internet and am having it delivered to a gun shop (pawn shop) owned by the friend of a friend.

I don't know the hours of this pawn shop but no one is currently there. FedEx tried to deliver it twice today and will try to redeliver it again on Monday. If no one is there on Monday, it might get shipped back to the previous owner...who I already paid for the gun. So best case, he re-sends it and charges me shipping again. Worst case, he stiffs me.

The package is addressed to the pawn shop C/O me. FedEx said that I can pick it up tomorrow at the mail center with the tracking number and picture ID (verified it from a couple of people).

Anyone see a major twist here that would get myself or the pawn shop in trouble? As soon as I get it, I will take it to the pawn shop and complete the transaction (including paying him for the transfer) and fill out the paperwork.

Unless you're the owner of the pawn shop and have the FFL in your name don't believe it's legal. You'd be bypassing but FFL and taking possession of the gun.
 
:eek: Absolutely right. It would be a violation of federal law for you to take possession of the gun/package without the FFL. Don't do it.
 
As already stated, that would be illegal. Having dealt with Fed Ex regarding similiar circumstances I'm sure they'd be happy to give it to whomever signed for it or maybe a neighbor.
 
Receiving a Handgun from FedEx

I can tell ya this, FedEx is a real stickler for the rules. Handguns are sent 2nd day air or overnight only. FedEx will not allow delivery to any other address than what is listed on the package. As a Locksmith/Gun Dealer this pisses me off to no end, but is Federal Law. Fedex will not even give my package to the hairdresser next door,Even tho I have authorized them to do so.In fact the hairdresser has the same exact address as the package does, but package will only be left at my store. Now if the package is full of Rifles, no sweat, they'll leave those wherever I say.

Fact is it is Illegal for you to take possession of this firearm without it passing through the hands of a Federal Firearms Dealer. Legally since this gun has crossed state lines Federal Law says,it must be entered into your gun dealer's Bound Book-required recordkeeping ala BATFE.

Just isn't worth saving a few bucks on extra freight or the waste of the extra time to probably lose your gun rights forevermore!

Although there is no reason why it cannot be sent to a responsible gun dealer the second time!

Yeah, didn't do it. Fedex will try two more times starting Monday. The FFL had a family emergency and didn't have coverage. I will get it on Monday hopefully.

I can tell you from personal experience that Fed Ex will deliver a firearm to a different address from the one listed and will not even ask for a signature on a package marked "Adult Signature Required".

I can tell you that I've had items delivered next door and not signed for, this is in violation of federal law.

Well HAGS, I sure wish I had your problem. My problem is as a Locksmith/Gun Dealer I can't be in the shop all day waiting for my delivery idiot to come by whenever? I listed the times I would be in the shop, but FedEx doesn't give a crap- They come whenever it suits them. I'm currently in the process of changing all my vendors to new vendors who don't use FedEx-at least not the next day/second day air FedEx, as they are my current problem.
 
I can't be in the shop all day either, so I arrange for people to be there to sign for it. My trouble is the same as your's, they show up whenever they want to. Even as a business address with set hours doesn't help.
