Emerson ruling??

There have been two decisions already and we won both of them. It will be sent to the Supreme Court in 2001, whether they hear it or not is still up in the air. If they decline, then the Circuit Court ruling stands, which we came out pretty good on. With any luck the SC will hear the case and Clarence Thomas will get to write the majority opinion. I would guess we will know by next summer.
 
Fill me in. What decisions have been made? The SAF site is like navigating in a house of mirrors.

Emerson won his first case in federal court in Texas. He also one in the federal Circuit Court. Only one place left to go.
 
I heard that the Emerson decision (5th Circuit out of Louisiana) was due to rule this month but have read nothing about it.

Anyone have a direct URL to the text of the ruling or any good article on it?

Just an additional note: The link above via UPS45 has a link to the 5th, but they then ask you to pay for their services. So, any other links allowing us to read about the basis of their decision would be appreciated! I figure that after paying enough taxes to buy a German luxury car last year, I should be able to read the friken decision without paying. This reminds me of writing the California D.O.J. asking if the knife that I had was legal. They refused to help me. So, for nine grand to the glorious state of Taxifornia that year and after living here for thirty-seven years, I ask for a service and they tell me to take a flying leap. Gotta love it!
 
This is wierd. I just spent 30 minutes on findlaw and there is no mention of US v Emerson in the 5th's records. The only returns I found for the name were on Emerson Electric, and Admirality case and some woman named Emerson (not the wife). Any lawyers out there with ideas on this?

Emerson won in U.S. v. Emerson in the northern Texas U.S. District Court. I believe there was a state matter that Dr. Emerson won as well - see http://www.saf.org/pub/rkba/news/EmersonStateWin2.htm

Originally, most folks believed the 5th was waiting until the election was over before they ruled. I always wondered about that logic, but whatever the case, we're still waiting. Now it seems more likely that U.S. v. Spruill was holding Emerson up - see http://www.saf.org/pub/rkba/news/Spruill.htm


Looking forward to a 5th Circuit decision in this case. And, I certainly hope that GW's Justice Department won't be arguing that there is no individual right to keep and bear arms. It will be very, very interesting to see how the Justice Department handles it from here on.

Jeff is correct. There has been no decision as of yet from the 5th. I was really hoping to get a good Christmas present this year... Looks like it is not to be until next year....
