A good book about where emerson case might go is FOR THE DEFENCE OF THESELVES ASDN THE STATE some of what it says is as follows

out of 71 final state court ruleings only 6 denied the people the right to posses non concealable weapons, and two said that ONLY weapons usefull to the milita were protected. 13 other decisions recongnized military pistols as protected. Ane now a little about the senario if the supreme court ignores the state court precedents for the last 200 years "Finally, the Supreme Court has a fourth option--to hear a case, overturn the existing precedents of US V Cruikshank 1876 and Presser, and ignore the overwhelming number of state supreme court decisiojns that have recognized the right to keep and bear arms as an INDIVIDUAL RIGHT. But this last option has risks. Many millions of Americans will become angry, afraid, and will lose confidence in the integrity of their government--and those millions will be forced to look to the arms they possess on that day and make the choice: "Use it or lose it." Unlike other factions whose rights have been stepped on throughout American history, owner of "assault weapons" are in a position to experimentally determine if firearms can be sued to overturn a modern government. Win or lose, the results will be unpleasant.
The American Revolution was started by teh British Government forcing the colonists to make such a choice. Will we see history repeat itself?
