Man armed with BB gun killed in robbery attempt

A man armed with a BB gun died while he and his partner tried to rob a pair
of Charlotte businessmen Thursday outside a motel on Broad River Road,
police said.

The robbers didn't know these were ex-military officers, one of whom built
his career on teaching anti-terrorism skills to state officials, according to
newspaper reports.

Jonathan James Berry, 32, died outside the Best Inn at 1029 Briargate
Circle after the businessmen shot him three times in the chest and once in
the side, Richland County Coroner Frank Barron said.

Police charged Berry's partner, Richard Sean Harley, 32, of 1119 Shirlington
Road, with attempted armed robbery and conspiracy to commit armed
robbery, according to jail records. Harley was not injured.

Harley, who has history of stealing, driving and domestic violence offenses,
was being held in the Richland County jail on $50,000 bail, reports showed.

Richland County sheriff's spokesman Cpl. Chris Cowan said Thomas Bullins
and John Nettles will not be charged in the 1 a.m. shooting.

"They were lawfully carrying weapons," Cowan said. "They were well within
their rights."

The men did not know the guns aimed at them weren't real, Cowan said.

Bullins, reached at his North Carolina home late Thursday, said he did not
want to talk about the shooting.

"It was an unfortunate incident," Bullins said. "Right now we want to spend
some time with our families and put it behind us."

Bullins told investigators he and Nettles were leaving their room when Berry
approached what he thought was a handgun and raised it to Bullins' face.

Berry demanded money from Bullins, but Bullins grabbed Berry's forearm
and the two got into a struggle, officials said.

Bullins then reached into his pocket and pulled out a .22-caliber handgun,
firing one shot that hit Berry in the aorta, Barron said.

That turned out to be the fatal bullet, Barron said.

After the first shot was fired, Nettles came out of his room, officials said.

Nettles fired from a .45 semiautomatic, hitting Berry three times in the chest
as he continued to struggle with Bullins, Barron said.

The men, who are also trained paramedics, performed CPR on Berry, but it
was too late, the coroner said.

The men went after Harley, who was nearby at the time of the holdup, but
later fled, Cowan said.

He was caught near the pool at the motel, officials said. They held him until
sheriff's deputies arrived.

After the men recovered the weapons from the thieves, they realized they
weren't real, Cowan said.

Sheriff Leon Lott said Bullins and Nettles were in Columbia to find out about
South Carolina laws governing security companies. They had meetings
Thursday at the State Law Enforcement Division and the police academy.

"They are ex-military Special Forces," Lott said. "They picked the wrong two
guys because they're trained to teach people how to handle exactly the kind
of situation they had last night."

Special Forces soldiers are carefully selected, specially trained, and
capable of extended operations in extremely remote and hostile territory.

Interestingly enough, the 2 guys also tried to do the right thing and save his life. I have a feeling they actually feel pretty crappy right now. No way they could have known it was a BB gun of course, but I'm sure they're not happy about killing some inept moron with a Daisy.

reminds me of the (almost certainly urban-legend) tale of the guy who tried to rob a 7-11 with a knife.

What he didn't realize was the chap behind the counter wasn't your typical brain-dead convenience store clerk- he was the owner.

Not only was he the owner, he was- like many convenience store owners- an immigrant.

He was an Israeli imigrant.

Back in Israel he had once been in the IDF.

In the IDF he was an instructor.

An unarmed combat instructor.

By the time the ambulance showed up the would-be assalaint had a broken arm, a broken jaw and had been stabbed with his own knife.

Like I said, almost certainly an urban legend, but everyone likes a good story. I sure did. :)

I was near there that night at that time , with my fiancee(-one mile/10 mins.). I was un-armed. :eek: That makes me feel bad/mad. That will be the last time that happens! Crap! That makes my heart skip a beat. I am not worried about myself but, my fiancee is another story! The worst part is that until I read it here, I had not heard about it. :eek:

Spartacus has a similar story about two young perps, armed with at least one knife, who attacked an older ex-Spec Ops soldier he knows. Ask him sometime...
 
Heh, heh. Two young punks tried to rob this 70 year old ex Green Beret. (Veteran of special ops in Laos about 1964) He cut them very badly with their knife.

Feel bad about shooting someone armed with a BB gun? Not me. Not even a little bit. Not even if I identify the gun as a BB gun before I open fire to stop the threat. A BB gun can permanently blind you. There are also major facial nerves that can be reached by a BB gun resulting in permanent severe agony. Both of these injuries are within the parameters of lethal self defense in the state of Georgia. Of course, as a registered nurse, I would attempt to save his life after I stopped his threat. But feel bad? UH UH.

Back in LA four knife wielding teenagers accosted an old man and his wife as they were entering their car. Brandishing their knives, they demanded his wallet. He reached beneath his seat and produced his bayonet. Figuring they enjoyed numerical superiority, the four laughed off the old man's defiance. Well, all four wound up in the hospital with stab wounds. Turns out the old man was a WW II Ranger who hadn't forgotten his lesson. Go Vet!
 
There was an incident that I saw that was filmed in a convinience store.

This guy walked into the store, and walked up to the counter. When he reached the counter he began to draw a weapon. The guy behind the counter moved more rapidly then I have ever seen someone move, came over the counter and apparently beat the would be robber senseless. The counter guy was an ex-special forces, or at least thats what the news said. This was all caught on tape, and shown on the news.
