Does a FFL dealer need a CHL to carry in public?

Friend and I were talking today and were discussing this. He said buddy of his is ffl and he told him that he dont have to have chl to carry....

That didnt sound right to me exactly but didnt know

Yes, unless he is an LEO, he needs a CHL/CCW, regardless of whether he is an FFL. An individual state could grant automatic CHL/CCW status to an FFL but I am not aware of any that do.

An FFL allows him to deal in firearms under federal law, period. It does not allow him to carry a concealed weapon which is a state/local matter.

1. Hope he doesn't get caught. If he does:
2. Hope he has a really good lawyer.

Not that it will matter, given today's political climate. His FFL will be gone, he will be spending a whole lot of money on lawyer fees and fines and quite few years in the Greybar Hotel (AKA Club Fed) while Eric Holder uses him as a poster child to abolish FFLs.

Tell him "thanks a bunch" from me.

I didnt think that was right, I will be sure to inform dude tomorrow to let his buddy that has the FFL that he can NOT do that and get his head out his ass and get CHL for the sake of the rest of us that are legal.

Thanks for the info

It depends on what state you are in.

In GA you don't need a carry license to carry at your place of business.

Maybe there's a need for clarification. One can carry without a CHL, provided that they're open carrying in a state that allows it. The OP never specifies that guy is carrying concealed. But open carry would be a right everyone has in such a state regardless of whether or not they have an FFL. If the guy is on his own property then he can open or concealed carry without a CHL as well, but again, this would be true whether or not you have an FFL. Furthermore, there are states that don't require a CHL to carry openly or concealed in public, but again these laws apply the same regardless of whether or not you have an FFL.

So basically... it is possible under some circumstances or in some states for an FFL holder to carry a firearm without a CHL, but it's not the FFL that allows him/her to do that, but state law that allows the same thing non-FFL's as well.

How does the above quote have anything to do with Concealed carry of a weapon??????

Dead wrong! In Wisconsin (home of un-reformed Taxahaulics) you will be violating the law if you CC on your own property (even inside your own home). Stupid, I agree -- but the state capital is in the land of lost liberals still trip'n from '60's acid.

Maybe with the new bunch of crooks --er-- I mean "politicians", the law will change. The new R gov has stated that getting CC will be a top priority. Only time will tell. He can do it or he can get voted out on his rump.

Open carry or conceal carry? In some states any one can open carry without the need for a license so it may not be that he doesn't need a license because he's got an FFL but simply because he isn't required to have one.

I had to chuckle at this because my father-in-law was packing a pistol in his pockets for the last 45+ years until recently without concern because he was an MP (AP?) in the Air Force back in the early 60's. Someone had told him he was good to go to carry concealed because of that fact. Our lawyer daughter help to straighten him out on the true facts, so then he went and took the class and is fully legal now. Funny how some incorrect rumors get started. :)

In short, yes in some states concealed carry OR open carry is legal without any kind of permit. However, all of this has absolutely NO bearing on whether or not an individual may have an FFL. As stated above, ATF states very clearly that an FFL does not give any right to carry a weapon at any time or any place, whether in the course of business or otherwise. That is strictly a local matter.

As good as it must feel to attempt to call BS on someone, keep in mind the OP (and thus presumably his buddy, and the FFL-holder in question) are not in Wisconsin. Concealed carry being illegal in Wisconsin is irrelevant.
