Does a Public Drunkeness conviction count?

Hi:

My friend has a public drunkeness conviction (he pleaded guilty) under his record. I was reading the NRA website law summary for California, and it said people with certain misdemeanor "convictions involving force or violence" cannot own a firearm. I was wondering if he can still own a firearm?

Date of conviction? He probably won't qualify for CCW. I believe if he paid his fine/did his time, he can purchase firearms.

reading the NRA website law summary for California, and

Sniper, CCW is Concealed Carry Weapon license. I doubt public drunkeness on its own would fall under violent behavior on its own. But if the background check comes back refused, he needs to follow up to make sure the judgement was correct, and not assume it was due to that misdemeanor.

this is information will apply to california law since thats where i reside. in general, some of the information may be applicable to other states as well.

First CCW = carrying concealed weapon

as far as public intoxication the (california) penal code is 647(f) which states:
* any person in a public place
*under the influence of alcohol or drugs who
*is unable to care for his/her own safety or the safety of others
*or is obstructing a public way.

no where in there does it state the use of force or violence. also you only have to be as far away as just outside your doorstep to be in a public place. i take it your friend was pretty intoxicated to be charged with this or doing something which pissed off an officer.

I think a conviction where there was a use of force or violence is probably aimed at domestic violence convictions most likely. And the CCW laws are different in every state so you would have to check if he can legally carry concealed. But there is no reason he shouldnt be allowed to own or purchase a firearm. Here in Alaska as long as u dont have two class A misdemeanors within six years or been ordered by the court to alcohol treatment within three years your eligible for a CCW. So i would say yes he can still legally own a gun the CCW if he wants one he will have to check with the department of public safety or whoever handles the issuing of the permits in California.

I thought it was next to impossible to get a concealed carry license in Komiefornia :confused: ?? Can someone confirm or refute this pleaz :) ...
 
From what I've heard, even if his record were squeaky clean, he'd have a really hard time getting a CCW in California, unless he's got money and connections.

Incorrect.

Recieving a CCW permit in CA depends heavily in which county you reside. From the image below, only five known counties refuse to issue. The majority of the state appears in yellow; difficult but not impossible. Check out www.packing.org and see for yourself.

lol, he lives in Sacramento. Perhaps he should go to Amador ... Can he do that, or is he required to get a license through his own region?

No, you have to apply with the chief of police or sheriff with jurisdiction over the place of your domicile.

Some sheriffs also won't allow you to apply with them if there's a police chief in the picture.
