What if, hypothetically, he was telling the truth, that they didn't announce themselves? He seems like an upstanding guy who deserves the benefit of the doubt...I'm sure that he didn't WANT to shoot a swat officer (I pity da fool that does!). And what about his public defender being fired? Is there any hope for this guy or should we keep in mind that 12 people agreed over what happened and that's that. It sure doesn't seem right though...I'm afraid that in his circumstances I would have done the same thing. Also, how does one end up shooting an officer and not get shot himself? I'd have thought that they'd waste him on the spot ('specially if he shot my buddy, I know how close most swat teams are)

I would love some opionions from those in law enforcement.
 
I'm surprised that he was sentenced to death. I would think that (given the information in this article) even if he was convicted, the evidence could at least possibly help him avoid the death penalty.

If things went down as this guy said, it's a serious miscarriage of justice and he should be cleared and released with apologies (and any damages he can collect). However, if things went down as the police said (they announced and entered to serve a search warrant)...... well you know what, you still have to PROVE intent in this case. Maybe they did announce. Maybe the guy didn't hear. Who knows. But it sounds like the jury convicted him because they believed that this guy knew it was the police and shot for that reason.

Need the full story, but this sounds funny.

editted to add: i'm surprised as well that this guy wasn't at least shot, if not killed, on the spot.

For the detractors of law enforcement, it is in the realm of possibility that the dead officer's relation to the.... sheriff(?).... may have influenced the jury? Just a thought.
 
Thank Prohibition. Police use narcs to rat people out without thinking that a narc is just trying to protect his own skin and will tell you anything, resulting in a LEO's death. The poor guy didn't even have pot, if he had pot then maybe he'd have been a little more chilled than to grab a gun;) All this crap because of a stinkin' herb. And WTF is up with firing his defender? All sounds like $hit to me. It would all be funny if people weren't dying.
 
It is possible that he did have pot. The article noted that there was some.

Police found one gram of ashen marijuana in Maye's apartment (that's about a sixth of a teabag's worth).

Granted, it wasn't the stash. Just wanted a clear statement there
 
I'm watching 'traffic' on tv right now and I just keep thinking to myself how badly this so called 'war on drugs' is really going. I just read yesterday that incarcerating a pothead/dealer takes about 25k a year...while some of the best drug treatments cost about 15k a year...hmmmm. hows THAT for saving taxpayer moneys...And If they would just make the really evil things like cocaine and meth production/distribution a lifetime offence (makin them work in coal mines!) and simply tax the hell outta the more, shall we say, natural substances (things you might grow in your garden for instance). As addicted as we are to pharmacuticals, alcohol, and tobacco (and firearms :), there would be so much tax revenue coming in that those fatcats in washington wouldn't know what to do with it all. The war on drugs, in it's current state, is unwinnable. There's too much money flowing into too large a black market. Didn't anyone in charge take history and hear about the 1920's?!

ps: anyone ever watch the history channel and actually hear about why they made the prohibition in the first place? very interesting.
 
jibjab, you just blew my mind...i don't know what i'd do now...ahhhhhhhh! I get the heebiejeebies just thinking about the situation...especially since there's probably at least a dealer or 2 within a couple of houses (just a hunch...then again, not enough traffic (dealers houses usually have tons of traffic!). but still.)
 
When Marijuana becomes a life and death issue we as a society better take another look.
I remember several years ago taking my family to look at a cabin which was for sale in a nice mountain community. It was my wife and two little boys 3 and 5 and I. Kind of one of those life long dreams.
Sometime after we had given the place a good look we started down the stairs to get the kids buttoned up in their car seats for the drive home.
Literally out of nowhere came a guy in plain clothes with a firearm drawn screaming for us to halt as he moving back and forth violently. He was accompanied by a huge German shepherd that barked constantly within inches of my boys. Needless to say we were all traumatized by the event. Sometime during the ordeal the guy identified himself as a law enforcement officer.
We soon learned that he had been lying in wait for the owner of the cabin because he somehow varified that there were 3 potted little plants (marijuana) on the back deck sunning themselves. We also learned he was a resident of that neighborhood and surely had to know the place was for sale and we weren't the owners.
The only prudent thing left to do at that point was to just get out of there peacefully with my family in tact.
Subsequently I spent many hours with each of our children in an attempt to comfort them long term (years). I know to this day they've never gotten over it.
The good news is, thanks to just plain old stubbornness on our part, the cop got a new job.... pickin' fruit in another state..and some other stuff I can't divulge!
Today,our youngest a multible high honors grad from one of America's finest U's is presently applying to the top 5 law $chool$ in the country. He has a way of having the last laugh and setting the record straight.
I guess we're not good candidates for bully abuse..... public or private!
As to drugs, well..... we're doin' it backwards folks!
BTW,If ya want to guarantee an evil element's success just declare "WAR" on it. We're a little below the "Mendosa line" in that regard last I checked.

And the beautiful thing is that there's really no end in sight. I especially love how widespread and destructive the effects of alcohol/tobacco as well as the general social acceptace of getting drunk...often...while smokin that doobie (cuz your old lady's crazy, gotta cope) brings down the swat. It's a beautiful lie.
